Hi,

I overstayed my time outside of canada for 35 days, cause I completely forgot about a 2 month trip I had about 5 years ago, and half of that trip is inside the 5 year window.

Now I am going to apply for Humanitarian and Compassionate Grounds.

Do you think I will have a problem overstaying for only 35 days?

The reason I did leave Canada in the first place was because my Grandma was diagnosed with cancer, and I've been with her during the entire treatment.

Well, I"m really worried about loosing my permanent resident status.

Let me know if you'd think I'll have a problem.

Thanks

Did you already apply to renew your PR card without listing this trip? What happened when you did?

I think they will let you slide, especially if you can prove that your grandmother had cancer. Get a letter from her doctor. It might take a long time though.

I haven't applied yet, I'm going to apply tomorrow.

And yes, I did get a letter from the doctor with the whole history of her cancer treatment that started 3.5 years ago, and is still going on today.

And I also have been a full time student while I've been her with her, do you think that can also help?

Cheers

Since you haven't applied yet and you say your trip was 5 years ago, all you have to do to get your 730 days is wait 35 days and then apply.

Actually, that's the thing... I'm outside of Canada and I only have been present in Canada for 695 days in the past 5 years, but previous to that, I lived there for 12 years. I just never applied for citizenship, and now I'm worried that I will loose all of that, because I'm a month late returning to Canada. :/

You can not apply for a new PR card from outside Canada. Are you applying for a travel document then? Put the H&C reasons in there and hope for the best.

Yeah, I just want the travel document.

Well, thanks, I will try my best to explain and present proof of everything, and as you say, hope for the best.

Cheers
