Hello,

I am a Nigerian. I came to the USA in 2002 on a visitor Visa. I have overstayed since then. I am married to a Canadian who is in the USA on a religious Visa. We have a son and we are expecteing the next child. Now she wants us to relocate to Canada. Is it possible for me to get permamnent residence in Canada due to my peculiar situation. Some say I have to go back home to apply but my wife does not think she can stand the separation for the lenght of time this might take. I desperately need some advice.
Thank you for the responses so far. I will continue to enquire about some ways to get this resolved without a separation from my family, especially the baby that is due in March.

Your wife is a Canadian citizen. Thus, she can sponsor you while she is living outside Canada. The problem is that you have to return back to Nigeria as the application will be sent form CPC-M to your country of origin or the nearest Embassy there which, I believe, is Accra (Ghana). Because you are illegal in US the sponsorship file would not be transferred to Buffalo. You have to be back home if an interview is needed.
I am not sure how you will get your background check in US and how this may reflect negatively in your case. May be someone with same experience can advise you better.
