Hi everyone,thank you in advance for your reply.
My boyfriend is an international student of US and graduated this May. He is still in US right now but didn't apply for OPT because he thought he can come to Canada within grace period(stupid I know), so he is overstaying in there right now and afraid of back to his home country would affect anything.
He has applied to the visitor visa since the beginning of this May, but haven't heard anything back from the government of Canada until this morning. They are asking him to show the proof of his current US status which he doesn't have any. Is he going to be rejected or even banned from apply again if we just write an explanation letter to say he overstay because he is waiting for his visitor visa and want to apply for a graduate school? What do you think he should do right now
Will this overstay affect his application for canadian student visa?

It is possible his visa is rejected without current US status. Why…because if something goes wrong while entering Canada, he can’t go back to the US. He needs valid status in the US to enter Canada. Saying that he is overstaying his US visa while waiting for a visitor visa is a really bad idea. It shows that he is not planning to return home.

He won't be banned but there is certainly a chance he is going to be refused. When he responds to the letter he needs to be 100% honest about his current status and explain the situation.

If he is refused, he will need to return to his home country and reapply from there.

The chance of him getting visitor visa to Canada while staying in US without a status is not very high.

Not sure about US immigration process. But is that any way he can get any valid status in US now?

If not, I think he should return to home country and apply from there. Disclose his overstay for any future visa/study permit application. Hidding that is worst.

He is trying to find a school that still accepting student for the winter semester and hope he can get his F1 status back, we think it would work

Processing for a study permit averages 14 weeks so will not get into winter semester.

OP is talking about a US study permit, not Canada. F1 is US.
