I am Canadian woman living temporary in Mexico in process of gathering documents to sponsor my common-law partner who is divorced and has 2 children (5 & 7 yo) with his ex-spouse. He has divorce agreement which he fulfills however his ex makes him lots of trouble to see his children and is in process of fighting in the Mexican family court to modify the original agreement. It is obviously impossible for him to take children for medical tests and get any type of documents from his ex to open the door for the future eventual sponsoring of children. He has broken heart to the option of signing requested document of denying his right to sponsor his children in the future to come to Canada but on the other hand I am worry if this situation will prevent him (will get refusal) to come with me and our 2.5 yo child to settle in Canada.
My questions are:
1-What kind of documents should he show to CIC that he is not running away from his child support obligations?
2-How CIC treats applications of people who have children from their previous relation that will not accompany the applicant?
4-Can the issues with his ex-spouse cause the refusal of his application?
5-Will I ever be able to have my love (partner) with me and our child in Canada or as long as he has case in the Mexican family court he is disqualified to immigrate?
