Hi Everyone!
This is my first time using a forum, so I hope I do this right.

I am a Canadian living in Mexico with my Common Law American Boyfriend. We own a business together and therefor can not apply inside of America or Canada which is why I am lead to believe I apply as Outland?

I am getting confused because there is a lot of different paper work for Outland vs. Inland application.

Can someone please tell me if I am using the correct forums as a Canadian Sponsor living and working in Mexico, applying under Family Class?? IMM3908 - Sponsorship of a spouse, common-law partner, conjugal partner or dependent child living outside Canada

Hello and welcome!

The application package you'll need is http://www.cic.gc.ca/english/information/applications/fc.asp. IMM3908 is part 3 of the application forms (the portion that is tailored to the Mexico VO). You'll need to e-mail CPC-M (in Mississauga) Parts 1 (sponsorship documents) and 2 (his application), making sure you follow the specific instructions and add in any additional relevant additional documents listen in Part 3.

Note that for Mexico you don't (can't) submit police certificates upfront. You'll need an original request letter for the PGR that the Embassy of Canada in Mexico will send to you once your application is in progress.

Thank you so much for your response! I am happy to know I was on the right track and just got a little confused.

My "spouse" will be taking his medical test in Mexico City and does anyone know if we can submit the entire application at that point in Mexico City or does it have to be mailed?

You wouldn't happen to know the difference between IMM 3999 and IMM 3900? Both instructions look the same to me.

You need to mail the complete application to CPC-M (not Mexico City). The address is in the instruction guides.

Once you get past the introductions, you'll notice that 3900 covers the sponsorship portion (the forms you'll fill out), while 3999 covers the forms the PR-applicant will fill out (your common-law spouse). They include instructions for each form on a question-by-question basis.

FWIW, I usually encourage people to print go through the guides and the forms http://www.cic.gc.ca/english/information/applications/fc.asp, set aside a few hours to go through them, get a cup of tea (or coffee or water...) and go through it all end to end. Don't worry about getting all the documents (yet), just follow the instructions in the guides and fill out all the forms best you can. Make a list of everything you need to gather that you either need to submit or that you don't know and need to include in the application package. That should give you a first draft of your application and a lot of clarity on how much effort it will take to finish up.

I would consider doing the medical exam after you do that first draft because the CoPR's (Confirmation of PR status which your husband will get at the end of the process and would use to land in Canada) expiration date is the earlier of the medical expiration date or his passport. So if you do the medical exam right before submitting the application you'll get that much time on the other end of the process to plan your landing.

1. My partner and I own and operate a business together in Mexico and I am applying as his sponsor. I am concerned about our Income. We are in the middle of selling the business and if it does not sell before he is accepted we will leave the business closed and for sale. I have a job when I get back to Canada however as of right now I have no proof of income. What should I do about this application C?
2. I believe I have read we can not have a co-signer since we are applying under common law?
3. We have finished many of the forms but have not validated them because I am worried about the dates. Do you have a suggestion as to how far in advance of submission they should be dated?

1. Explain your plan to support yourselves (savings?) as you move back and settle back in to Canada. CIC will be looking for a solid plan for you to move back that has a reasonable chance of working without relying on welfare. Selling the business would be part of that, but what is your plan in case you move without selling it?
2. Correct. However, your partner's savings would count in the sense of being part of the plan.
3. For citizenship applications IIRC it's 3 months, but I haven't seen a hard limit for PR apps. Do note, though, that CIC periodically updates the forms. So right before submitting them, double check that new versions haven't been published (the date is usually on the bottom left of the form).
