Hi everyone,

I'm new to this forum, and although I've perused through a number of similar topics relating to the questions I have, I figured it would be best to seek your advise on my situation.

I am a Canadian citizen living in Toronto. My fiancee (from Malaysia) visited me earlier this month, and during her stay we got married (civil registration) and I'm currently waiting for the marriage certificates. We originally intended to complete and submit the application (outland) to Singapore. We have already organized all the necessary forms, proof etc., and the only thing outstanding is the marriage certificate. She left back for Malaysia tonight, and as we were at the airport (and trying to ward off the all too familiar bouts of sadness), we were wondering if it would be possible for her to visit here (Canada) while an outland PR application was in progress, so that we could plan our church wedding ceremony together. So my questions are:

1) Is it possible for her to visit Canada - presumably with a return ticket - and extend her stay in Canada, while the outland PR is in progress? Are there any complications that could arise from this (the main concern being voiding the PR app as a result of the visit visa)?

2) Is it better to hold off on the outland app, and do an inland app instead, although this would take much longer? Although this would mean we would have to wait longer to submit the application (i.e. until she visits Canada the next time and stays on)

From all the posts I have read on this forum, it seems like a number of folks have been able to successfully enter Canada (on a visit visa), while their spouse's outland application was in progress, and also extend it - as required.

I'd really appreciate your advise and suggestions on my situation, and the best way to proceed, as I do not really know many people who can provide qualified opinions through their own experiences.

At this point my "now-wife" and myself are definitely leaning towards Option 1 (outland app), as it will significantly speed up the process but at the same time I am concerned that a concurrent application for a visit visa may result in the PR application being cancelled. Hopefully this is not the case.

It's entirely possible for your wife to visit you while an outland application is in process. I'm currently also "visiting" while my outland application is in process. "Dual intent" is acceptable in Canada and visiting will not affect the PR application at all. That said, having a PR application filed may affect the application for a visitor visa (substantial risk of overstay in case PR is not granted?). Personally, I'm from a visa-exempt country and only base the previous observation on other posts in this form. Others can comment on that part. Also, keep in mind for inland applications, your wife must not leave Canada while the application is in process or there's a risk it may be revoked.

Thanks so much for your reply margobear! Malaysia is not a visa exempt country so do you think it would be a good idea for her to quickly apply for a multiple entry visit visa (which can be done in about 2 weeks) and then submit the application outland to Singapore via the Mississauga case processing centre?

It seems like the outland app allows flexibility to appeal and also for the applicant to reside either in the home country (outside Canada) or within Canada while the application is in progress.

Based on this, does it make sense for my wife to first apply for a multiple entry visit visa to Canada prior to us submitting the PR application, or does it not matter when the visit visa is requested? I'm only worried that a request for a visit visa after the PR application is submitted might cause problems.

Secondly, I've noticed a few posts mentioning that it may be hard to get an extension of the visit visa while an OUTLAND (rather than INLAND) application is in progress? Is this true?

Hi, You have to have 10 posts I beleive, before you can mail someone, its very quiet here at the moment because of the holiday season.

I guess your spouse might beable to get a multiple visa, especially as she has already visited you recently.

So do you think it's best to get the multiple visa first before submitting our PR app or would the order not be an issue?

Hi,

I really do not know weather you should apply for multiple visa before or after you apply for PR, but as she is now married, it might effect her getting a visa.

I'm not sure that timing matters since you're married now. There's obviously a risk of over stay? Personally, I'd say it would be better to be straightforward and mention the PR application. But again, I don't have experience with visitor visas. Maybe start a specific thread about that topic -- chances of getting a visitor visa from Malaysia while PR is in process. Good luck.
