HI

new citizsenship application requiering 3 years presence in canada in last 5 years , my question is sombody who was no status for 2 years waiting his permanent residence under sponsorship inland application , got approval on october 2014 Permanent resident landing application here in canada , this period no status he had spent in canada will be as protected person or what . is it going to be account for his presence in canada and under what category , not to mention this person was outside canada for the total of 4 month since landing october 2014.

This might answer your question. Mine goes as follows For the majority of 2012 and 2013, I was a visitor in Canada ( I didn't need a visa but I have stamps for most of it) 2014 I filed my application and got an active VR due to that. I landed in 2015. I have visited home several times since but the majority is in Canada. So I was a visitor for the most part of the past 5 years which every day counts for half as far as the counter. If a person has days as a visitor they can count those days. They don't have to be working, in school or a protected person. They are just other ways the days count. Days physically present in Canada count for half. But they will check to see the dates you entered or left in the CBSA system. So my VR and my talks with CBSA at the border, gave me a status. But the days out also count for some with the residence counter as well. So on those grounds, they may have to wait but legally physically present counts for something. Not everyone requires a visit visa to enter so they don't always issue one or even stamp the passport. Seniors can advise further.

1. IMHO if you had no status, i.e. neither valid visitor/work/study permit, then the time will not count.

Your time will only be counted from the date you actually landed in Canada as a PR. So, the date you went to your local office and signed all your paperwork is the day that you start counting. The only way that will change is if you got an OWP and job with your AIP before your actual landing. You were NOT a protected person, so please, don't put you were. You were not a refugee, you were sponsored by your spouse.

Although this is confusing, because for an INLAND application you need to physically remain in Canada under visitor's status. They advise you don't leave during the entire process. But many if not most were issued 'visitor's status' during the process. Or some type of status to stay. Unless they went against advice and left, they should have had visitor's status here. Then there is just what is 'visitor's' status. Not everyone requires a visa to enter so not everyone gets a visa and they don't always stamp a PP or issue a VR. I have stamps in my passport dating from 2012 because I told them I was visiting my boyfriend. I'd count that as visitor's status but they (IO) may not. The wording in many things trips people up I think. Just a guess.

Visitor status is not a valid status for counting days toward citizenship though, and that was the question. :D

Time you have lived in Canada
Regardless of your age, you must have been physically present in Canada for at least:

  • 1095 days during the five years right before the date you sign your application
You may be able to use some of your time spent in Canada as a temporary resident or protected person towards your physical presence calculation. Each day spent physically in Canada as a temporary resident or protected person before becoming a permanent resident within the last 5 years will count as one half day, with a maximum of 365 days, towards your physical presence.

Temporary resident status includes lawful authorization to enter or remain in Canada as a:

  • visitor,
  • student,
  • worker or,
  • temporary resident permit holder
The time didn't count prior to now. But the rules changed. So it depends what rule they are trying to go under. When I do my counter the days I've spent here count for half. Seniors can further advise if I am wrong,
