Yeah it's risky ponga I can certainly see that but inland have changed the wording so I am not so sure I am safe either way

One bold option, would be to call CBSA (from a public phone) and just ask them if either application would work for you, while you remain in Canada during the process. We all know that calling the CIC Call Centre is not going to be much help, since you end up playing the `Wheel of Knowledge' when the person answers your call. LOL!

You should definitely call and confirm and if you can get in touch with a immigration lawyer/consultant; most offer free consultation.

If OP still isn't comfortable with that very minor risk, then they can simply submit the outland application from here and remain here until it's processed.

Even though that person may no longer have ANY ties to their home country?

And, how would the officer know that there's pretty much no chance of the PR being refused? Does the child automatically cement the relationship and/or PR of the parent?

It seems as though the common child is the `ticket' here, so a person that either doesn't have a child with his/her sponsor, or is only a Common-Law couple, would likely be denied re-entry due to an overstay?

Seems a bit unfair, but...I can see your logic.

Yes, even if they have no ties. CBSA isn't stupid; they know that most sponsored partners entering Canada as visitors don't actually intend to leave, regardless of what proof of home country ties they show.

In terms of knowing the PR app will be approved, it's simply because OP is British; the refusal rate for Brits (like the refusal rate for those citizens from other countries as equally developed as Canada) is nearly zero. The same can be said of your app Ponga. You are American and have no criminal record (at least not that I've seen you mention ;)); it is not a matter of IF but WHEN your app will be approved.

The submitted PR app is really the "ticket", though the Canadian child helps as well.
