@Aquakitty Thanks for clarifying.Damn these guys lol..Ok so the proof of support meaning bank statements and maybe a letter from my folks would help?and after the pr is handed to me doesnt that instantly mean i can work without a work permit?like just get a sin number?

Yes those things would help, a joint bank account is a good idea. The more proof the better (within reason).

Once you get your COPR and "land" you can work without needing the work permit. But, this is gonna take up to 3 years with an inland application.

Technically, a person that is out of status can submit an Outland application (which us usually much faster than an Inland application), but there is absolutely no protection from being removed because of the overstay. Even those that submit an Inland application have no guarantee, although the vast majority are NOT removed, unless they were/are already on CBSA's radar for some reason.

@Ponga but to wait for 3 years for PR isnt that insane?i honestly thought it was 13 months.so if i should send my application outland,does this mean they will know im in canada and applying outland while im still in canada?and when they call me to get my pr if approved will i have to travel back home to pick it up?Last time i spoke to a lawyer they told me 13 months for my PR lol..i guess she was wrong.

Yes, 3 years is absolute insanity. It's possible that the processing times are getting better, but as of today it would take ~ 2-1/2 years if you submit an Inland application.

Outland is probably much faster for you (depending on where you're from) but because you have no legal status in Canada, you might be asking for trouble. No matter which application you choose, you MUST be completely honest about your overstay. It will NOT disqualify you for PR (if your sponsor is approved), but if you lie about this (or ANYTHING) on your application, it certainly will be a big mistake.

If you applied with an Outland application, you would show your address in Canada as your home address. If you managed to get approval, and were not removed from Canada, the CoPR document would be mailed to you (in Canada) and you would then need to leave Canada (briefly...like literally, present yourself at the border and be asked to be turned around to re-enter Canada) to the land as a PR.

The pandora's box is that you have no legal status, which is why almost everyone in your situation chooses an Inland application...even with the ridiculous wait.

Oh...and you obviously would not want to leave Canada for any reason during the process...because the chances of you being allowed back in would be smaller, because of the overstay; you'd, in essence, be trapped in Canada, which isn't exactly a bad thing. ;)

For inland is 17 months for stage 1/AIP (after which you get OWP), and then 10 months for stage 2 = 27 months in total. Inland apps are not processed in Ottawa, they are processed in CPC-Mississauga and then I believe Vegreville Alberta for stage 2.

For outland it's 57 days for stage 1, and then stage 2 is depending on your visa office. There is no OWP with an outland application.

If you did decide to try outland, I would not expect CPC-Ottawa to be your visa office, I would expect your country of citizenship to handle your case. If you share your citizenship, you may get some better feedback.

Not sure how legal your "side business" if any of that work is conducted here, but hopefully this isn't an issue.

For financial criteria, only the sponsor needs to qualify here. If she has not already started school at the time you apply, I wouldn't even mention it. Just include the Option C form from CRA showing her last year's income, and her employment letter. Of course you can always include letters of financial support from either family as well.

@Ponga Ok makes alot of sense.So is it that my processing time would be longer inland because im out of status or does it take just as long if i was in status?and when you approach lawyers,do they actually go ahead and process outland because i know that some out of status people have gotten their pr in a year.Unless im wrong?

Inland takes that long, but a person without status may have a bit longer wait.

Ask your lawyer how s/he can guarantee that you will not be removed from Canada if you submit an Outland application.

Ask him/her why the Public Policy that was put in place back in Feb 2005 only offers [certain] protection for an Inland applicant?

Yes, again, Outland is far faster, but if you get thrown out of Canada...what would you do?

@Rob To thanks.My application will be for Zambia.I see, so it makes sense why she the(Lawyer)told me it will take 13 months to get my P.R because now i figured she would apply outland!!!Because there is no way she would tell me within a year and then have me wait for 2 and half year lo land my buSiness is just buying electronics from Canada and sending them back there.

Uh oh...I may be mistaken, but that could be seen as illegal work in Canada...because a Canadian citizen or PR could also be a seller of those same goods to Zambia (or anywhere else in the world).

An Inland application will for sure. Even with an Outland application, if you are removed and issued an Exclusion Order, banning you from returning to Canada for a year or more, it will be a major problem for you.

You may have no other option than to submit an Inland application and hide in the basement (half-kidding).

Your best option, IMHO...is to leave Canada and submit an Outland application.

@Ponga if one is purchasing stuff from Canada to sell in there home land isnt that just trade from one country to another?its not like its being sold in the same country.id understand if that was the case lol..if anything im bringing more money to the country im i not?please correct me if im wrong.

Yes, but it's trade revenue (coming into Canada) that a citizen or PR of Canada could do, right?
