Hello Everyone,First off thanks for this forum its really great from the stuff i've read so far.Anyway I came to Canada as an international student and lost my status due to financial reasons.I've been Out of status for a year and half now.I'm currently Engaged to My Canadian Fiance and getting married soon.My questions are:

1)Would i be able to apply for an open work permit after first stage approval when we submit the Pr application?
2)We are planning to submit our application in Dec-Jan and she intends on going to University in Jan.Right now she has a part time 30 hrs a week job.The fact that she will apply for osap and go to uni in Jan does this affect her sponsoring me in anyway?
3)As far as proof of relationship,is 3 months of gathered proof enough,as far as bills and house lease because we are only moving in together at the end of this month and intend to send in the application by december?
Keep in mind i'm from a visa required country.Anyway hope you guys can help me out,Thanks.

1) Yes, after AIP but not the pilot programme.

2) No, only welfare matters.

3) You can't apply with 3 months of proof. There is no fiance option for Canada spousal PR. You either have to get married, or prove that you have lived together for one consecutive year.

Yes, you CAN submit an OWP after you have first stage approval (AIP).

Even those without status qualify for the regular OWP after they reach AIP.

This website is so slow, I didn't have time to correct it after I realized I misread it, yes you can apply after AIP, but not pilot programme.

They won't look at only the 3 months you are married, how long have you been together? You should use everything from the time you got together. Being out of status from a visa-req country might make them more suspicious of your intentions. So, I would have a LOT of proof to show, much more than 3 months worth.

A copy of your marriage license will be one of the required documents that you must include with you application. That alone provides a lot of proof. Those that apply as Common-Law, or Conjugal partners have a much larger burden of proof, which is why they need more than a married applicant does.

You should provide evidence of your relationship before you were married (photos, emails, text messages, etc.) to show that the marriage is genuine. You don't need to worry as much about proof of living together [now], unlike a C-L, or Conjugal partner would. Send what every you can gather when it's time to apply.

we have been together for a year now but you know sometimes u dont really think u will end up with a person in the future so the proof isnt as much.just a couple of pics here and there but now we are starting to take more pics due to the fact that we have to apply for pr.Most couples rarely take pics ;D i know with my last relationship which was 3 years i only have 2 pics with that ex..

Ok i see..so does this mean they have the right to check our phone records or texts because some of the stuff is personal that we text?lol..so we should just send texts that are relevant to prove our relationship?And thats cool im sure will have the marriage certificate forsure when submitting the application.

They don't check your phone/computer...you simply include print outs of messages/emails that you want to share...but don't be afraid to include some of the `romantic' ones (within reason), as well as a few that might be when you were having an argument...because real couple sometimes argue, right?

With the pilot program you would have gotten OWP within 4 months of submitting the app.

However since you are not in status you don't qualify for this so must wait for AIP. So the difference is, you will not get OWP until approx 17 months after submitting the app (based on current times).

Also, not sure if it will be an issue but how are you supporting yourselves, especially once your fiance goes back to school? As you are out of status you should not be working illegally, and if you are that question may be raised by CIC/CBSA.

Hahaha,good point @Ponga,you the man!!!lol thank you very much.and as far as receipts go,do we have to show them even our food basics receipts?or does it have to be only reciepts with our names on them?because we went to a hotel this passed weekend and the said only one name could be printed on the receipt so im wondering how they go about the whole receipts thing if we have to make it look like we do things together?i know travel tickets are pretty obvious.

Hey @ Rob,thanks for the reply.so you mean after the first stage approval(60 days) i will not be eligible to apply the owp?i thought thats what first stage approval meant and not after 17 months?and again i thought the waiting time for inland ottawa will be 12-13 months from what i heard?Anyway i have a side business which i send stuff back home and live off that and plus i have my family supporting me till i get through everything so i will be managing the rent but she will work part time too.But should she even mention that she is going to school next year?

See, I thought you might be confused on this, the approval we are talking about is called AIP (approval in principle). You are probably thinking about the OWP pilot programme that gives you a work permit after about 4 months (if apply for it with your inland applcation).

AIP = ~17 Months
OWP Pilot Programme = ~4 months

Unfortunately because you are out of status, you must wait for AIP to get a work permit. Unless you leave and come back with status, but that might be a bad idea seeing as you overstayed, it's unlikely they'd give you another visit visa.

She can mention going to school, it will have no impact. But, you need to show how you intend to support yourselves. Take more pictures as well, you'll need some.
