hello friends,

I've been out of status here in the USA for 4.5yrs do you think if I applied for an immigrant visa in CANADA as a skilled worker would i get approved. im one of those people here in america whos application for H1 visa been denied and under appeal up to now. i want to move on nothing is happening to me here. by the way i dont have an state id here in california i just use my passport as my identification. would it be hard for me to get a police clearance ( im a good citizen here i pay my taxes ) or they would deport me directly to the airport if in case i applied for a police clearance.

Please help me

I would say you can get your clearance since it's done by mail.

But I'm not sure if you can apply while out of status, Where are you from? Why don't you apply from your home country?

the LAPD wont touch you as far as immigration goes, thats not their job and have no right to do so, However!, OCPD does, so it depends where in CA you are, most likely they wont bother you since they are more interested in getting Mexican Immigrants (which is racist but thats what it is) in case you are in the BAY SFPD is cool, now, you can only apply in Buffalo if you have a CURRENT legal status which means you cant apply in the US you would have to mail your paper work to your home country and go from there. I know this because im in the US on a TN visa and they told me it had to be current, plus i had to be here for more than one year if i wanted to apply in Buffalo which it did not make much of a difference to me since MX city is only 3 months behind as far as processing time goes. I hope the same is true for you.

Now, since you wont be able to apply in the US then you dont need to worry about the FBI prints.. (in case you wonder about that)

The application through the U.S. depends if when u were admitted you were admitted lawfully for more than one year (tourist visas dont apply b/c those are for about 6months) then you can apply through Buffalo keep in mind you have to have evidence of the visa. You might run in to problems if you have an interview but you are allowed to apply though Buffalo. And here is the quote from the CIC site "you have been lawfully admitted into the United States for a period of at least one year and you are submitting your application at the Canadian visa office in Buffalo"
Anyway that's what I get from that quote. I'm sure other member can provide some more insight.

thanks for all the people who replied im from the philippines, im here on a tourist visa yeah i was given a six month visa but thats already expired so i guess i just have to wait for amnesty here in the usa (if theres gonna be any)

pangalan palang alam ko pinoy ka... you in a bad situation, i suggest you go back to our country and apply the right and legal way...... if you apply in buffalo they will find out your there in U.S. as an illegal tourist due to your overdue visa, only people with valid visa from the us can apply in buffalo, believe me they wiull find out your case, may kababayan tayo na gumawa na nyan, i he's from marina california and he was hacked by the IRS / FBI. manny7 people who is illigal in the U.S. is trying to escape to canada but i dont think or i never had heared someone pull it out...

If you go back, you might want to get an FBI certificate before you leave... Well... It might expire by the time you need it, but it wouldn't hurt.
