Out of country application while spouce in canada

One more thing what did you put as your address in your PR application. It ask there for both your Mailing address and residential address (point 14 and 15 in "Application for permanenet Residence in caanda" form). Did you put your canada address in either or both of them or back home Brazil address in both.
Did you also mention in application in section where it ask for the foreign countries you have visited with dates in last 10 years that you are currenlty in canada at the time of application.



I also want to thank everyone for your replies. It seems from everybody's replies like it is ok to apply for PR even if the person being sponsored is in canada on visitor visa.
As far as applying without FBI clearance seems to be 50-50 case as there is no concenses and depends on your luck and person reviewing your initial application.
The only other big concern i have is regarding showing the income. I didn't work in canada in past 2 years so didn't file any taxes there. I also have not gone on social security/govt. benefits and neither intend to do so once i reach back in canada. I know to sponsor spouce it says you don't need to show any minimum income but at the same time i read in forums and others reply that you should not apply until you can show solid income so that you can support your spouce.
I can show funds initially which should be enough to support myself and spouce for long time and my tax returns from US if that helps but i am confused how to approch this.
I want to apply for my spouce as soon as i reach canada may be with in month so that there is chance of it getting done before or soon afeter the visitor visa expires so even if she has to go back to country where we apply it should not be for long time.
Even if i get a job it will be less then month old i might not even have paystubs by then forget about tax returns as that will happen in 2011.
Any advise on this or if someone has faced simillar situation and can help that would be great.

My mailing address was the one in Canada, and my residential address was the one in Brazil.

Yes, I did mention that I was in Canada at that moment.

Can someone help me with following and ahare there expereience or can give some advise on this

Hi Corpus,

If someone told you that you need to show a solid income they were wrong. In a spousal sponsorship with no dependents you only need to show that you are not on welfare and not in bankruptcy. That is the entirety of the financial requirements.

If anyone starts telling you about requirements of jobs or income, ignore them. They are wrong. :)

Yes, that will be fine. Again, you must ignore everyone who tells you that you require a specific job or income. :)

What should i put in "application to sponsor undertalking IMM1344EA" Section C "PERSON BEING SPONSORED AND HIS OR HER FAMILY MEMBERS" Page 3 point 6 a) "Address where the person you are sponsoring lives" since my wy wife will be in canada so should i put her canada address there and then select "No" in next point b) we will select no as she wil be in canada for less then year so the application should go to outland processing.

The way I did was:

IMM 1344A / Section C / 6. a) Address where the person you are sponsoring lives: Brazil

But if she is coming as a visitor and answer the question 6. a) using the address in Canada, I guess it will still be processed in the Visa Office for her country of birth/citizenship, since she will not have been lawfully admitted for the period of at least 1-year. I received 180 days at the Port of Entry when I came as a visitor and extended it later on.

6. b): I didn't answer since the address on 6. a) was in my country of citizenship. If I had answered with the address in Canada then it would be "No" - because I was admitted in Canada for 180 days only.

7. Mailing address, if different from address in 6. a): Canada - but if it was the same as the residential address (which I answered "Brazil"), I would just answer "Not Applicable".

It was explained later, on IMM 5490 (Sponsored Spouse/Partner Questionnaire), "Living Arrangements and Financial Support", page 6, questions 28 and 29 - I answered "Yes" for both questions; a separate sheet was included:

"28 and 29 – Right now I am temporarily in Canada on a visitor visa and staying with **husband's name**. In Brazil I live with my family as listed on question 29 in the form IMM 5490, that is the reason I answered "yes" for both questions.""

So i guess you came to canada after applying for the PR but in my case most likely my spouce will be with me when i apply for her out of country PR so i am not sure if i give address in 6 a) and 7 of both canada or india in one an and canada in other.
Also for 28 and 29 on IMM 5490 i guess it will be yes for 26 and no for 27 for me.

No, I came to Canada on December 2008 and applied for sponsorship on February 2009.
