Option C form if not worked in canada for last year

I have canada PR since March 2007 and after staying in canada for few months (did not work during that period) i went to US and worked there.I have returned back to canada this month feb 2010 and will be stying here. Last year i got married and now i am applying for her PR. She is currently with me in canada on visitor visa.
The question i have that i didn't file taxes in canada for 2008 in 2009 as i was not here. I will be filing taxes with 0 income for 2009 taxes now. In PR application it asks for Option C form last years tax return but i don't have it so can i apply for her PR without it. I am going to call revenue canada tomorrow to find if they can still issue me Option C but i doubt i will get it since i didn't file last year any taxes. Can i send her appliction without option C form and explain them my situation that i was not here for last year.
Next related thing is should i attach my W2 from US for last year to show my last year income. I know they won't count it towards my income but for spouce as there is no income requirment i am just planning to show it so that they know i can support here. In case i show W2 can they ask me to pay taxes on that in canada. I will be paying taxes on it in US as my taxes are deducted there on them.
Has anybody gone through this kind of situation. Any advice will be welcomed.
I am still looking for job here and still have not started working in canada.

how come ur showing CPC that ur living in Canada? u have to be LIVING in canada if ur PR to apply for sponsorship...if ur citizen then it does not matter where u live.

To answer your question.. Yes you can apply to sponsor your wife without having worked in Canada and have an Option C print out. There are no financial Min required to sponsor your spouse. You also do not need to have a job.

You can either try and call for an option C print out which might come back blank or with min. information. Or you can send in an equivilant to an option C print out from America showing that you worked and paid taxes. Either way I would suggest sending a letter to CIC Missisauga explaning your situation. CIC Missisauga WILL send back your application if you do not provide a Option C print out... or some equivilant.. or an explanation.

Your letter can be as simple as this:

Dear CIC Missisuga,

Please find enclosed the American Equivilant to Option C Print out for 2009. I was working in America from 2009-2010 but am now living and working in Canada there for I do not have an option C print out.

or

Please find enclosed the Option C print out which is blank (or whatever). Please note that I was working in America from 2009 - 2010 but have returned to Canada where I am now currently working (or not - doesnt really matter)

or

Please take this letter as notice that I have not enclosed the required Option C Print out as required. My reasoning for this is because I had worked in America from 2009-2010 and there for claimed no taxes in Canada. Please feel free to call me if you require any further information.

I would also recommend writing a similar letter (or put it in the same letter as the option c) explaning why you do not have a letter from your work.

That would be as simple as

Since I have finished my work program in the US i have currently not found a job in Canada but am activily looking.

Just make sure they are convinved that you WILL be staying in Canada while you are sponsoring your wife since you are a PR.

I have already moved into canada as of Jan 30th this year and will be staying here now.
I was also planing on writing a letter explaining my situation and getting Option C with 0 income for last year but is it possible that they will ask me that why i didn't pay tax on US income in canada as i talked to some CA here too and as per him technicaly you are suppose to do that and pay partial tax in US and Partial in canada but that is so complicated that they on't advise anyone to do it.
If anyone has any experience with this kind of situation and can share some info. that would be great.

I wouldnt worry about the tax issue.... I too myself was wandering about a few tax mishaps but to be honest with you CRA is a total different division than CIC Missisauga and even if you owe a few thousand dollars from the previous year in taxes CIC Missisauga is not going to deny you on that basis....

If anything CRA or whom ever will contact you on their own.... and you pay up and your good to go...

I know its hard not to stress about small things like that but if I was you I would start working on that application ASAP since it does take a while to complete....

I applied for my husband in Feb 2009 at that time I had enclosed my Option C for year 2007... since 2008 taxes were not completed.

This will be similar to you if you send off before the next tax season... they do not know if you have paid up all owed taxes now that you are back in Canada. Dont worry be happy!

thanks for response but in my case the qustion is that do one need to pay tax in canada if they stayed outside canada for whole financial year and paid taxes in the other country where they where living for that year.
