Opening a Business

Hello,

I have an unusual case and I am hoping someone knows how I should proceed.

I am Australian and I have been in Canada for 3 years - the first 2 years (plus 90 days) I was on a Work permit (WHP/IEC), then applied for a new LMO and work permit (with no success despite 3 attempts and a Highly skilled work position) and I have also applied for Permanent Residency.
I am currently only on a visitor Visa until my:
PR comes through (likely another 4 months)
or I get my second WHP visa (applied for 3 weeks ago).

My fiance is Canadian and we have a child together and while we are waiting for my work rights again my Common law spouse would like to open a business and have both our names on the franchise (although I will not be working until I have a permit) so it is jointly owned.
Am I allowed to do this? I know I cannot work without a permit but can the business be in both our names? we already have a mortgage together - I consider this to be similar but I am really not sure.
