Hello! I am an international student in Vancouver. I and my girlfriend are in our relationship for 10 years and we decide to get married in December. We are going to perform wedding ceremony and register marriage cetificate in Canada because same sex marriage is not allowed in my country. I am worrying that if my girlfriend can get open work permit after she uses visitor visa to come to Canada or not. I am afraid that CIC will reject her application because they think that we are trying to bring her to Canada.

yes she can get an OWP if you apply for your spouse and be able to apply/submit a substantial proof as your spouse. In my opinion, giving your situation of same sex marriage, if properly channel; it can be the strength of the whole application

Thanks so much for your replying. However, in the position that she can not get OWP are there anything effect on her current visitor visa? Will it be cancelled? I am afraid that she can not get OWP also her current visitor visa is stopped. That will be terrible.
It won't be cancelled, your spouse or common law partner needs a visit visa to come to Canada if not already in Canada but if your spouse is already inside Canada, the visit visa is needed to keep her visiting status valid while she applies for OWP.
FYI: the OWP is not a travel document but with the visit visa it permits your spouse traveling out and granting reentry so it won't be cancelled.

Has she been able to get a visitor visa? That would be the big challenge. If you have lived together continuously and can prove it she could apply for OWP now. Spouses of international students aren't guaranteed OWP. One of the big concerns will be your ability to support yourselves as your future wife waits for an OWP or if she can't get a job. She will definitely qualify for an OWP once you have PGWP, full-time job in NOC 0, A and B and 3 pay stubs.
She is an international student in US now and she already has Canada visitor visa. We are not living together now. Do you know how long it will take for applying OWP? Should we ask helping of lawyer or visa agency or from someone who know clearly about OWP to help us apply this form? Do you have any recommendation for us to apply this?

choose the duration that best suits your wife's study permit duration as it will be linked to it. It should be more than 6months since she has a 2yrs study permit

As I want she should continue her study and I can go for open work permit, though I’m also having a study permit, if I get open work permit then it will more convenient for both of us .i don't want to continue my study, i want to work full time to support my wife ,as well as enhance my work experience in canada.
1.So my enquiry is if husband and wife both are full time student in canada ,then can one of us apply for open work permit inside Canada.
2. what is the procedure to apply for open work permit in side canada .
3. Is there any one like us who have came (husband & wife) canada as a student and then one of them applied for open work permit & successfully got the open work permit ?
I’m looking forward to hearing from all of you as a matter of urgency.
