Open Work Permit

Hi,

I am a Canadian citizen living in Berlin, Germany at the moment but will be moving back to Canada within the next 2-3 months. My wife who is a German citizen has submitted her application for an Open Work Permit (owp). If she gets approved for the owp will this be enough for her to enter Canada?

One final question, does my wife need to enter Canada with me when I move back or can she come in by herself afterwards in about 2 months?

The plan is once she enters Canada and she finds a job, she would apply for a permanent residency from within Canada.

Sorry for so many questions but it has been so stressful these past few days trying to find answers to these questions. We just want to make sure we process the applications properly and ensure that we are not separated for too a long period since we are newly married.

Any advice would be GREATLY appreciated.

on what basis u r planning to apply for her work permit ?

Hi,

i don't see how she can obtain a work permit :eek:
the best way is to enter canada as a visitor since she is from a visa-exempt country,it will be valid for 6 months and can be extendable from within canada but not allowed to work.once she is in canada you can apply to sponsor her for a permanent resident either inland or outland application.
also once she is in canada she can change here status from a visitor to a worker but she needs to find an employer willing to give a job offer and go through the complicated process of getting an approved LMIA before she can apply for a work permit(the work permit will be tied to one employer in one location for a specific job) she has no chance for an open work permit as of now.
maybe if she is in canada and you apply inland to sponsor her for permanent residence which takes longer then outland application but after the first stage approval i believe she will be eligible for an open work permit.

I thought she would apply for an open work permit for International Experience Canada (IEC) aka Working Holiday. Unfortunately, I can not post the link of the site but I found a site from immigroup.com for top-7-fastest-and-cheapest-ways-immigrate-canada. It's stated in #4.

The initial plan was to apply for a Family Class immigration where I would sponsor her but it would take 14 months for the process. If she could apply and obtain an open work permit under the International Experience Canada program (which she meets the qualifications) she would be able to enter Canada and be legally able to work. I also thought she could apply for a Federal Skilled Worker but that process takes 15 months.

We are newly married and would not want to be separated for 14-16 months and she would also like to work to contribute to the family budget.

if she qualifies to the IEC program then its her best option to initially get to canada and apply for PR from within,sorry i forgot to mention that in my earlier post.

I realized that I submitted my wife's application as an Open Work Permit (owp) instead of the IEC program. So I re-started the process (not submitted yet) only to find out that the IEC quota has already been met for this year. So she won't be able to use that application.

So I am back to where I started. The owp been submitted and is in process. My wife is gathering the required supporting documents for a Family Class application and I will be submitting my sponsorship application for her.

Since the owp takes only 3 months to get approved and the Family Class application takes 14 months, will my wife be able to enter Canada with an approved owp while she is waiting for her Family Class application to get approved?

So I must sponsor her using the inland process in order for her to be accepted for an OWP when I am in Canada? Is there no way other way? I will be moving back to Canada in 10 weeks which means she can only apply for a OWP then? Also, according to the process time for an OWP from the Vienna office, it states that it would take 3 months to process an OWP. If that is the case and she does get approved would she be able to enter Canada while waiting for her Family Class application?

Thanks for the information, but how is my wife supposed to enter Canada to apply inland if she doesn't have a permit? Does she need to enter in with a Tourist Visa and then apply inland then head back to her country and wait?

If your wife is German then she can enter Canada as a visitor using her passport alone. She doesn't need a permit.

If she applies inland then she needs to remain in Canada while the inland application is being processed (not return to Germany). It would be a far better idea for her to apply outland. It should be a much faster process overall.

I would second all the info scylla provided.

@scylla one question / i thought and would have. What if she applies out land for Spousal sponsorship (and expect faster processing) and meanwhile go to Canada as a visitor (doesn't need visa) and stay there (or get extension) until out land application is approved?

Or is there any rule preventing you to be in Canada while your Out land application is being processed? like the one for being in land? Just wondering

There is nothing preventing someone from being in Canada while an outland application is being processed. My husband was in Canada for most of the time his outland application was being processed.

i have applied SOWP online outside canada, and planning to apply FSW14.

Please clarify whether should i apply fSW14 or not
