Open work permit March 2023

Hi all, my wife has been in Canada since February 2023 with a closed work permit.
After the new rule made by IRCC on November 16, 2022, we applied for my open work permit in March 2023.
So far I have not heard any updates, We have reached out to IRCC on multiple occasions and no response, we also sent a Demand letter to escalate it to federal court, but still no answer whatsoever.

has anybody gone through this stage?

We don't even know which Visa office is processing my application.

Please help.

Where did you apply from? How did you get the federal court involved with a demand letter?

We have applied from Armenia, we have not yet escalated it to the federal court, but have mentioned in our demand letter, that if we don't hear anything back in 30 days, we will escalate it to the federal court by we I mean the immigration firm.
My wife got the approval visa on November 8, 2022, a mere difference and I would have also gotten mine if they made the decision 1 week later after Nov. 16 as the new law was introduced.

How can you escalate it through federal courts? Through what process? You are threatening IRCC with no substance. Processing is 35 weeks, so if you applied in March then you haven’t even passed processing times. It is not IRCC’s fault that you didn’t apply at the same time as your spouse.

Processing was changed to 35 weeks through the last update, the processing time for Armenia was less than 20 weeks for the past couple of months. For instance, in August the processing time was dropped to 15 weeks only. and 9 WEEKS in July.
My application has not been updated since it was submitted, Biometrics and medicals were also submitted in advance for their convenience.
We applied the applications together when we applied for the first time, hers got accepted, but mine got rejected. We had to reapply after the new law was introduced.

So you were not eligible the first time so reapplied. Processing is based on the time as of today so 35 weeks. I am trying to understand what will be your process through federal courts given that you have not passed current processing times. And making demands to IRCC with threats of taking them to court when you have no basis doesn’t expedite anything.

so when we sent out the demand letter the processing time was 15 weeks, which made me more than eligible to ask for the whereabouts of my application, but they have not yet replied to that.
the processing time of 35 weeks was announced 2 weeks ago, I am eagerly waiting for IRCC to update the processing time hopefully soon as they have not for the past 2 weeks.
What happens if next week the processing time changes to 10 weeks? where do i stand then?
