Open Work Permit / Implied Status

Hi Everyone,

I have a question regarding an Open Work Permit application. I applied for my Open Work Permit when I sent in my application for Spousal Sponsorship in June. I have application & UCI numbers, but when I log into the CIC website, it only shows that my Sponsorship application is in process, no mention of my Open Work Permit. I also have not received any email confirmation regarding the work permit. I’m wondering if this is normal and what I can expect regarding my Open Work Permit application? How long does it normally take to arrive and should I hear something about it, etc?

My other question is about implied status/SIN… my current visa expires September 10, and I will then be on implied status but my SIN will expire with my visa… from what I gather I can continue to work without a SIN until my Open Work Permit arrives or a decision has been made. I’m wondering if anybody else has run into this situation and can confirm if this is correct?

The OWP is separate from the PR app and needs to be linked to see it's status. You will not get anything saying they have it.

Being able to keep working depends on what work permit you currently hold. You can only keep working if it is a permit that is extendable. If IEC, or another that is not extendable, you must stop working upon expiry. If it's a work permit that can be extended then yes you can continue working until a decision is made on three owp.

Given that you are on IEC there is no implied status after September 10th. You can stay but can't work. IEC is never extendable.

Another question regarding this...by stop working does that mean I have to resign? Or can I go on unpaid leave until my new OWP comes through?
My employer has also said he can send me to New Zealand to work remotely. Is this allowed?

I don't think you need to resign if you can arrange unpaid leave with your employer.

Regarding to working remotely, how are your employer going to pay an employee with no valid work status in Canada?
Do they have a New Zealand office/branch to pay you?

We do have a new zealand branch but I do think that means resigning from the canada branch.

If I am able to take unpaid leave without having to quit my job that would work best.

I've been here for over a year so do not want to start the clock again. My employer would prefer me to stay on as an employee and just take unpaid leave also
