Hi,

I am sponsoring my wife for permanent residency. She is currently living with me in Canada under a Study/Work permit and we are submitting an Open Work Permit with the Spousal application. The document checklist includes the form IMM5409 Statutory Declaration of Common-Law Union. It says "if applicable" beside this form. My thinking is that we don't need to submit this form because we are married and included a copy of our marriage certificate with the Open Work Permit application (we are not common-law because we are married). Am I right?

yes you are right.....you are married and not common law....and should not submit IMM5409
