Open work permit for Spouse on TRV(Temporary Resident Visa)

Guys I need help on a situation that has presented itself to me.

I am a landed PR but in India. I did my landing in Nov 2016 and came back as I had ot left my job in India.

I got married in April.

I am now planning to move to Canada for good along with my wife. What are my options for her visa application so that she gets to work as soon as possible.

My plan:

Take her on a Tourist visa.

Apply for her SCLPC visa along with an open work permit.

Although the wait time for inland spouse visa is longer the open work permit should make up for it.

Big question, can I apply to sponsor my wife without a job in Canada.

Your help will be much appreciated.

Yes - you can sponsor her without a job. The hard part will be getting the TRV approved. In this scenario - TRVs are typically refused. However you can certainly try and hopefully you'll get lucky.

Hey,

Any idea how should I present my case?

Why do they refuse. Its an honest case of taking my wife along.

Should I say this in my invitation letter:

'I am a landed PR who came back to India for my marriage.

Now I am taking my wife along. I will apply to sponsor my wife along with an open work permit once I am in Canada. THis is because I want my wife to be able to work while she awaits her permanent residency approval. '

This is the wrong approach and it will result in refusal. TRVs are meant for people who are genuine visitors to Canada and only plan on staying in the country temporarily. They are not meant to be used to move to Canada early ahead of getting PR. If you want to have the highest change of approval, your wife will need to demonstrate that she has strong ties to her home country (e.g. property, employment). I would request a visit of 2-3 weeks. If you are successful, she can always extend her visit once she's here.

Another option : go back to Canada-apply for sponsorship of spouse -wait for acknowledgement- once received apply for visitor visa for your wife.

You have to mention this information - it's specifically asked in the forms.

HKG, thanks for your reply. The thing is If I apply from Canada and she is in India, I cannot apply for an open work permit along with the sponsorship application.(as OWP is only available for SCLP in Canada class. My wife is a CA, I want her to work as soon as possible.

scylla, a similar question - I've no intention to hide or provide false information to CIC, but if the application stated that
1) married 2) spouse's status in Canada(Permanent resident)

will the application of TRV get rejected at very high chance? If so, should I not apply TRV (since my spouse are holding a passport from visa-exempt country). Once we arrived in Canada, I keep extend its visa, is it possible?
