I believe that the answer is yes but, as suggested, employ a lawyer to help you. However, if you fail to obtain PR or citizenship, once you have expired your open work permit, your ongoing options will be very limited. I don't believe that you will be able to obtain a closed work permit in relation to that business. It will give you no immigration advantages.
