I work for a multinational employer (US based) in ON (on temporary work permit). Prior to that, I was working for the same employer in U.S. for few years.
1. If the employer decides to terminate without cause, how will the notice period be calculated? Usually, if the employee has 1 year of experience, it would be 1 week, for 2 years of experience, 2 weeks and so on. My question is - Is it just the experience in Ontario that counts or will the U.S. experience also count?
2. Also, in the original agreement that was provided by the employer, it was written that the employee could be transferred to any location (even outside Canada) where the employer has presence. Due to some reasons, I don't like to relocate. So, there is also a possibility that instead of terminating, the employer could transfer me outside Canada. If I refuse to relocate, could it be considered as a cause to terminate the employment (with just cause)?
