Hi, my immigration file had been rejected in August 2008 and officer mentioned that they gave me time to send them updated documents till 15 May 2008 which I wasn't able to submit so based on the documents they had they gave me points which is obviously rejection.

Although I had sent them request at email to get more 2 months till 15 July to send the updated documents as my residence permit of Saudi Arabia was expired and I had given it for renewal to my company. I got reply from CIC in May that, submit IELTS registration for first available IELTS. This means they accepted my request, otherwise they could have reply me in simple "NO".

I sent them updated documents + 1st available IELTS registration before the time which I had asked which was I think 2nd of July 2008. But I got refusal in September 2008 with some mistakes. e.g.

1- I am from Pakistan but officer said that my institute which is in India is not registered with Indian govt.

2- I had added my wife 1 and half year ago, she is a dental surgeon and I sent her attested documents with fee but officer didn't gave me points of her education.

3- I had mentioned about my brother who is permanent resident of Canada. I sent his documents with PR Card 2 times but they didn't give me points of my brother.

These 3 things I had already mentioned to CIC before they reject me. So I again sent my updated documents with original IELTS result in September 2008 and mentioned these mistakes and requested them to re-view my file. After waiting 2 months I sent email at 1st December 2008 and mentioned these mistakes and remind them that I have asked them 2 months' times.

Then I got reply on 4 December that my request will be look after shortly. After that I didn't get any news from them. Although I have sent them 2 more mails, 1st at 4 Feb 2009 and 2nd at 6 April 2009 that at least let me know the status of my file and requested them softly to review and reassess my file again.

Yesterday I check my online status, previously it was "Decision Made" but now its showing that "In Process" but inside when I click its showing me the same old message that “A decision has been made and office will contact you regarding the decision."

Is this mean that they are re-viewing or re-assessing? Or status can be change by mistake? After sending the updated documents and original IELTS result in September I am contacting CIC through email, so before watching my status I was thinking to send CIC a fax and ask them weather they will review or reassess my file or not.

What do you guys think? What should I do? Shall I wait for more 1,2,3,4 months or send CIC a fax?

Please guide me.

Btw officer gave me points

20 for Education
10 for Age
21 for Experience
Total = 51

But what I should get are

20 for Education (Minimum)
08 for Language
10 for Age
21 for Experience
04 for Wife as she had done Bachelors of Dental Surgery
05 for Brother who is a Permanent Resident of Canada
Total = 68

from what I have read,
In my view, your case has been judged on a "Mistaken Identity"!!

I personally will give them @ least 1-2 Months, if not a little bit more time before asking them, as they seem to be working on it.
This is evident from the change of status on eCAS according to you.

Well Thanks alot boby, just want to confirm for my satisfaction that eCAS status can't be change from "Decision Made" to "In Process" by mistake?

If yes this means they are reviewing or reassessing my file?

Just to share with you guys.....

Last week I got letter from CIC stating that they have reviewed my file and asked me to send them my & my wife's original degree + transcripts with settlement funds. They gave me 60 days to submit these documents starting from 14 April. So finally I am back on track :) Thank God, this is a big news after 9 months.

One thing more I want to share is the letter is stamped from Sweden but my file is in London and the address inside the letter is the same old London address. Even I double checked file number it belongs to me.

Any idea?

Regards
Imran

Hi all,
i applied as skilled applicant on July 2008 where my applied my NOC wasn't in the newly published 38 NOC list.
I got the acknowledgment from them and it provided my Immigration file number and i could see my status online mentioned initially "ON PROCESS" but tonight i found the status "APPLICATION RECEIVED" which they meant "Application Received by Citizenship and Immigration Canada (CIC)
We have received your application. After checking for completeness, a file has been created and the information from the application form was entered."

Does any of you have this kind of experience?
if yes then what happened next\?

Tnx
Omer

for your first point actually i didn't understand what do you mean exactly (number 1)

for your wife if she has the first degree only, you will be awarded 4 points not 5 as in the following link :

http://www.cic.gc.ca/english/immigrate/skilled/factor-adaptability.asp

finaly, for your brother who is a permenant resident of canada make sure that you send documents show and prove that he is currently residing in canada along with his landing records and permanent resident card ( because if he is a canadian citizen or permanent resident who is living outside canada at the time of your application you will not be awarded any points from your relation with him) as in the link below :

http://www.cic.gc.ca/english/immigrate/skilled/factor-adaptability.asp

my advice is to make sure about these things to know exactly how many points you have and not to leave anything to the luck( people do not apply everyday to immigrate so try to do your best when you send your documents to gain the right points)

Thanks Professional1 for your reply, actually my first msg was very long so I didn't mention some details like you mentioned.

1)
I belong to Pakistan and I have completed my education from Lahore, Pakistan. I don't know why officer thought that I am Indian not Pakistani or I studied in India. The reply I got from officer at the refusal time that my educational institutes are not recognized from educational authorities of India. So I mentioned this mistake at my letters and emails to CIC.

Well if you saw the expected points which I had entered above are same as you are mentioning.

2) For my wife's degree, yes I know we can get 4 points not 5 and I had mentioned only 4.

3) For my brother, I had sent CIC Xerox of his PR Card, tax documents, salary slips from current employer, credit card statement, bank account statement, Xerox of house lease, his birth certificate, my birth certificate, my father NIC, My NIC, his NIC, his marriage certificate, my marriage certificate and obviously he is living in Canada and doing job. So that makes 5 points.

If I was wrong or if I was not getting 67 Points then why they contacted me again and asked to send original degree + transcript + settlement funds? NO WAY after refusal.

Onwards I'll make sure as you said about all things which they need and which I have to send. I have arranged almost everything which I need to send which I'll do within 2, 3 days.

Currently I have 19500 CAD in my bank account with a reasonable transaction history and I am expecting one more payment from my client within 1, 2 days of around 1500 CAD. So total would be around 21000 CAD for 3 persons which I think is enough to show, officially I have to show minimum 16500 CAD.
If I send them after 1st June then I can get more 5000 CAD (Salary + 1 more Payment from client) but I think showing more money will not make any plus point on immigration decision/process or it will?

Best Regards
IR

Thank you bobby and professional1.

One thing I don't understand is the letter I've received is sent from SWEDEN not from London as I can clearly see the stamp of SWEDEN.

Any idea? I have sent all my documents to London office and even all emails to London office.

Regards

Imran
