Offered Job in Canada - Need help on how to bring my Girlfriend with me

Hi Guys,

I hope someone can help....?

I'm from the UK and I have been offered a job in Vancouver. As I understand it I would be going under a Temporary Foreign Worker Visa.

I would like to bring my girlfriend with me, we have been together for 2 years. I need help on how she can come with me.

I've been told by my prospective employer that she could come with me as my common law partner if we could prove that we had been living together for at least 1 year.

We have been living together for 9 months, however because she doesnt earn very much I rent the property we live in and pay all the bills...her name does NOT appear on any of the bills or the tenancy agreement. The only thing that she has proving that she was there is some parcel receipts when she had things delivered. All her normal mail goes back to her parents house because we dont like changing our addresses every time we move to different rented accomodation which is every 6 months.

If we could set up joint bank accounts and add her name to the utility bills and tenancy agreement now would that prove that we were in a common law partnership or would we need to show records going back for 1 year???

My gut feeling is that we couldnt provide enough evidence to show that we were cohabiting or sharing bills etc so my other thought was whether she could obtain a BUNAC (Working Holiday) Visa which would allow her to work in Canada for 1 year. During that time if we set up joint bank accounts and rented a place together would that 1 year in Canada count as the minimum requirement for Common Law status so that when her visa expires she could be added onto my Temporary Foreign Worker Visa?

I would really appreciate anyones help or experience with similar things, I'm supposed to accept/reject the job offer in the next couple of days and it all depends on whether I can get my girlfriend to come with me!?

Without proof of a one year common law relationship, she would not be able to come to Canada as your spouse. Also, only certain categories of jobs allow you bring your spouse on a work visa. These are usually in NOC 0, A and B.

She could however try for a BUNAC, although I believe that has now changed and CIC are using another way of allowing young people to work in Canada for a year. Check out CIC website, or do a search here on this forum.

The proof required for a common law relationship is much less when a foreign worker is bringing a spouse over than when a PR or a citizen is trying to sponsor a spouse.

There is a form you can fill out, a declaration of a common law relationship. You can look at it here: http://www.cic.gc.ca/english/pdf/kits/forms/IMM5409E.PDF

I have never heard of a foreign worker being denied to bring a spouse over because immigration didn't believe they were really common law. Doesn't mean it hasn't happened but I have never heard of it so it probably does not happen often.
