Offer letter but not LMIA

Hi,

I am planning to apply for PR under CEC category. I already have 1.5 years of work experience and have a valid offer letter, however, it does not come under LMIA category. Also, the job nature comes under LMIA category. I got to know through someone that the company can raise the request for LMIA and it will be free of cost. I have confirmed with the company and they are ready to give me that letter but they need the complete procedure.

Does anyone have an idea about the process to convert employment letter into LMIA.

Any help will be appreciated.

LmIA is long an tedios process, Your employed needs to go through a long process for that. Most of employers are not willing to do that (includig mine), the chances of getting LMIA approved is not 100%.You should try for PNP programmes otherwise.

The actual application will not cost anything to support your PR, however they still need to go through the full LMIA process. This includes advertising your role for a month prior to submitting all of the paperwork. These items, the advertising and time taken to gather the submission will cost the employer. It is specifically outlined that you cannot pay your employer for any of this.

Getting positive LMIA is not very hard(my personal experience), all need to be done by your employer, however you need to follow the certain procedures to apply LMIA, eg. advertisements in 3 different sites including jobbank for a month and etc.
It will cost 1000CAD to your employer to apply PR LMIA for you. It will take approx. 1 month to get result after submission.

My employer submitted LMIA application in april 01 and got approved in april 20th this year.

My company paid $1,000 to process LMIA to support my PR application, and I already posted the link that says it costs employer 1,000 for LMIAs supporting work permits. If you pay $1000, you can also use the LMIA to obtain TWP.

If you do not pay $1000, you cannot use the LMIA to obtain TWP, it may be used for PR purposes only.

Read the text in the blue box on the page you quoted. That's where the fee exemption is explained. I think this fee exemption is a pretty well known fact here and won't come as a surprise to most members.

It means my employer needs to apply under this category, however, it says that "hire the foreign national only after their immigration application is processed". I just want to make sure that it will not impact our process and employer can still apply for LMIA only for PR.

Last but not least, if someone can provide me the list of documents need to be filled by employer for LMIA(only for PR) would be appreciated. I do have but still want to reassure myself.

There is a checklist on the last couple of pages of the application form that outlines fairly clearly which documents need to be submitted.

And yes, you can apply in that category while you are working there without impacting anything.
