Obtaining Canadian visitor visa after work permit denied

Hello,

I was wondering if it is possible to obtain a Canadian visitor visa if work permit application was denied.

My friend had applied for Canadian work permit (from outside of Canada) but his application was denied. Earlier he had overstayed in Canada by a month (under a tourist visa) while his application for extension was being processed. He comes from a country for which only eTA applies.

I was wondering if work visa refusal (along with 1 month overstay in Canada) will prevent his re-entry to Canada as a visitor? Is there a time limit for which he has to wait to obtain a visitor visa following his work permit refusal?

In theory there is no problem.

But the CBSA officer will want to know what is his buisness in Canada. He will need to convince the officer he 1) will not overstay 2) use his stay to look for work 3) violate the terms of his new entry.

The CBSA officer will then decide if he will be allowed into Canada, under which terms and for how long.

Should he be denied reentry would that cause a permanent "flag" in his record which will prevent success in his future applications. Seems like there are mixed reports saying that a person cannot reapply for 3-5 years following a refusal. I know some of these question do not have a very clear answer and lot of time it is up to the discretion of CBSA officer.

I am trying to help guide him make a good decision on whether to reapply or just wait for a year to reapply given that earlier wok permit was refused. Perhaps reapplying after a year may buy some sort of "goodwill" if there is such a thing when it comes to immigration.

As you said it all comes to the CBSA officer. No one can say what may happen.

Waiting times are usually stated by the CBSA officer on refusal. Can go from no waiting time to 5 years or more. This is case specific.
