Yes - it's misrepresentation. CIC will view this as a lie to gain an immigration benefit (failing to declare a criminal record). Based on what we've seen on this forum, even though 12 years have passed, he's technically inadmissible and will have to go through the rehabilitation process to be allowed to enter Canada. Expect this will come up when you apply for PR if you don't deal with it now.
