Hi.I have a question and I would appreciate any imput as I am new at this.
I worked with a locum agency doing part-time/locum jobs but the taxes were very high.So,I haveopened 4months ago my on limited company to bring taxes down to a minimum.Now I find oyt that from the time my firm came into existance I stopped effectively beingan employee but rather self employed....The locum agency provided me a letter stating that I still use their services with no mention that I am now self employed and not an employee of theirs.
I have never been so stressed in my lufe as the last thing I want is for all the above to be considered misrepresentation (not stating I have been selfemployed for the past 4months) and my application rejected or even worse banned 5 years.
What do you think I shouls do?

I fear many self-employed folks have something or the other to worry about. I have a 1 year+ experience working per diem and contract works (professional services). And I have similar concerns. You're not alone.

Having said that, there is no misrepresentation as long as you include a brief LOE with the letter provided by the agency. I am doing something similar and am including receipts of some payments received.

I hope this helps. I ask self-employed folks who have gone through the process to stop by and provide more info.

Unfortunately from the date you commenced operating this company you are a "deemed" business owner of the company you started. The possible fiduciary obligations on you as business owner include the right to collect and remit GST/HST, possible obligation to pay income taxes on taxable business profits etc.

In the view of CIC you will not be deemed to be an employee. I'm currently in a somewhat similar position where I am on the recruitment agency payroll but having statutory deductions coming out of fortnightly pay, I don't supply tools used for work, I cannot set my working hours, I don't have GST/HST obligations as my contract period and estimated wages are well below the $30,000 annual threshold.

To be 100% sure of my case I will apply for a private ruling. I suggest you do the same to be 100% sure before rejecting a possible ITA.
