Hi all,

I landed in Canada in Dec 2015 with Permanent resident and left to work in US in Nov 2017. Since my wife is still in Canada, I travelled a lot and got around 200 days of physical presence in Canada. Tax wise, due to the tax treaty between US and Canada, I filed non-resident tax in the past two years.

I plan to move back to Canada soon and make myself qualified for the 3 years in 5 physical presence in Canada requirement. Does anyone see case like mine? Will they count the 200 days' non tax resident days?

I believe the 200 days will be counted as you were in Canada as PR status.

I would like to know how you can file non resident if you spent more days in Canada than out of Canada. And if your spouse lives here sometimes they will treat you as you have residency here. Tax treaty has nothing to do with it. I do a lot of work in the US to and have to count for days in Canada and US and typically get a credit from the US tax return to apply to CAD tax return. But do have to file in both countries.
