I am a canadian citizen living abroad as a non resident and have an american boyfriend. We would like to move back to Canada to live and work.

We live together overseas and have proof of annual lease fulfillment etc.

What are the steps needed to take for him to live/work receive visa?
Does it matter that i am a non resident even though i have citizenship and proof of common law relationship.

You will need to sponsor your boyfriend for permanent residency. It doesn't matter that you have been a non-resident - you'll just need to prove that you have lived together continuously for at least one full year.

There are two different paths you can take. You can apply from outside of Canada. Processing will take around 12 months and once PR is approved, your boyfriend will be able to live / work in Canada.

You can apply from inside of Canada. This would require you to return and also your boyfriend to come to Canada as a visitor and remain here. This process will also take 12 months. However you can submit an open work permit with the application which will be granted in around four months - and which will allow your boyfriend to work while he waits for PR.

Looks like you would apply for common law spousal sponsorship.

Your decision is to apply yhe inland or outkand route.

You can apply NOW as outland. For US / Canadian couples, take about 6 or 7 montgs start to finish. You can remain with him in US, but would need to 'prove' to CIC you plans and intent to return to Canada once approved (a LOT more than just saying 'I will, honest').

You can only apply inland if you are both IN Canada and stay there for the likely 12 m9nth duration. He would inititally have to arrive as a visitor, but you can apply for an Open Work Oermit fir him at tge same time as sending your papers in. He could NOT work in Canada until OWP approved, which takes about 4 months.

1. How long do you live together? Is it at least 1 continuous year?
2. Do you have legal status there? Does he has legal status there?

Thank you all for the prompt answers.

We both live and work in Cayman Islands on Work Permits. He is from USA and I am from Canada. We have lived together for a little over 1 year and have proof via lease/bills in our names

then there should be no problem to apply for common law sponsorship. Since you are Canadian citizen, you do not need to return to Canada during the application process, but you have to show intention to return to Canada.
