My husband received a letter today advising that we have 60 days to get medical, fbi, etc done. The problem is, we have no contact with him.... We have not heard from him in quite some time. Does anyone know who we contact to have him removed from the application or if it is even possible?

I'm the Sponsor.... and that part is approved. His son (from a previous marriage) is 18 (19 in October). We have no clue how to get ahold of him.

You should contact the visa office (CPC-Ottawa?) to explain the situation. State that the applicant has no contact with his son, and in any event he was in the custody of his other parent. Explain that you are aware that excluding him from the application would mean that he can never be sponsored under the family class.

The outland processing manual (pdf, page 11) has a section on this:

Officers may wish to have applicants sign a statutory declaration indicating they understand the consequences of failing to have the family member examined. [/quote]

Proof that your husband has no contact would be advisable, such as a copy of a custody arrangement giving the child's mother sole custody. This exception is intended to be only used when a non-accompanying relative cannot or will not be examined, not simply when it would be inconvenient to do so.

He is still a minor by CIC's definition. He will stop being a minor once he actually turns 19..

Although that won't affect the ongoing application. For immigration purposes, the ages of children are "frozen" when they are added to the application, as otherwise we'd have a perverse scenario where a long process makes some kids "age out" of eligibility.

If we had known it would take 2 years, he would not have been included at all.... he has no desire to be here... I sure hope they can just take him off.... hubby needs to be here for his daughters, the ones that want him in their lives!

You didn't have the choice not to include him. It was mandatory that he be included in the application (all dependents MUST be listed). Otherwise your husband would have been committing misrepresentation (lying in his application) and would have faced a 5 year ban from Canada.

No - it has nothing to do with that. CIC wants to ensure that dependents aren't excluded as family members and can be sponsored in the future. This requirement is there to help families stay together and protect children's futures. It's not a money grab.

As Scylla said, money has nothing to do with it. The total amount of fee remains the same regardless of how many non- accompanying dependents are listed on the application.

If I put non accompanying on my dependent can is still sponsor him in the future? I declared him as my dependent I just didn't put him as will accompany me to Canada at least not yet.

Provided he is included in the app and has his medical, yes, you will will able to sponsor him in future.

And to add to canuck, you can sponsor your dependent in the future before he/she turns 19. Once your dependent turns 19, he/she is no longer your dependent, thus not qualified to be sponsored by you.
