Do a search sometime on the CanLII website using 117(9)(d) as the keyword and start reading through the appeal transcripts for refused applications where people who have previously immigrated to Canada have tried to sponsor spouses and dependent children that they conveniently "forgot" to include in their applications when they immigrated because they felt those family members might somehow interfere with their approval. It's pretty pathetic.

Frankly, to require a medical exam for the non-accompanying dependent child of a spousal applicant (and especially to require forfeiture of the right to ever sponsor that child in the future if the exam is not completed) is ridiculous - because spousal applicants and their dependent children are excessive demand exempt. The results of the medical examination have absolutely no bearing on the admissibility of a spousal applicant anyway - and there are so many instances where applicants are not able to convince their ex partners (or their children) to get an exam. I even know of one applicant whose application was recently refused because his ex refused to allow their child (designated non-accompanying) to undergo examination. I was interested in what paragraph of the Act was used to justify that refusal but, unfortunately, he never responded to my inquiry.

So, it's understandable that this issue is a controversial one . . . unfortunately, doesn't look like the requirement is going to change anytime soon.
If you look at reports in CanLii the persons who "forgot" spouses and children emigrated in the skilled worker class where excessive demand is an issue, and after "landing" tried to sponsor. Also a high no. of the cases are children that were not declared in spousal applications because there was a very good chance that CIC/CHC would have queried the relationship.

And here. I thought my time line and issues were complex. Congrats on finally getting your landing papers in Jan of 2011! I was staring to feel like I was the only one who tried to appeal or was one of those people who has the worst luck no matter what with this application.

So here's a question for you if you still visit this sight. Worth a shot
I do have a question thou. What if after being I touch with the other child's Parent ( in our case mom ) who the child lives with and mom has full costudy of the child refuses to take the child for Medicals ?
We have sent her the request and at first she agreed to take the child but has since Changed her mind.
We have it in writing via email correspondence that she does not want to take the child.
What will happen now? I know we need to send this to the officer processing our file. But will they want anything else ? We will still send the birth certificate as requested since we have a copy of it.
Can they refuse our file? Or will they delay it ? It's so sad that the other parent doesn't see they are denying there own child of something. Any info or help is greatly appreciated.

You should send the email correspondance and proof that she has full custody. It would be better to get a signed statement from her stating that she refuses but maybe the visa officer will accept an email. At least you can try but it can delay your file if they get back to you later and want more proof.

Am glad i have found this forum.
In my case, i did not do medical for my Non-accompanying children (02) because i thought it was not such strict. But i declared them in my application and stated the reason for non-accompanying as a future plan since i want to first get PR, stabilize and then sponsor them later.

My application is still in process, so is it too late to do my children medical now and send it? Please help and advise because i cannot afford to loose the chance of ever sponsoring my children. Thanks for your response.

It is not too late to do their medicals now as long as your file is not closed and you should. It is also very likely that immigration will ask for your children's medicals and even refuse to process your file unless you provide them.

Hi members,
I would like to if while sending the medical receipts/form for children to Nairobi, should i also send copies of the notary public that proves my custody of the children? Or since they are Non-Accompanying i should wait until their time of sponsorship.
Looking forward for your usual prompt response.
