Hello,
I am wondering about the length of the implied status while waiting for a reply from the government.
I came to Canada on a work permit and have been living here with my common-law partner since February 2010 (she's a Canadian PR). My work permit was valid for one year and my employer said he would extend it. So in February 2011 I stopped working and sent a request for an extension of the visitor status so I can wait for my new work permit from within Canada and be together with my girlfriend. I applied on February 10 and asked for a short extension until June 1st (as I assumed I would get the work permit until then).
The bad news is that my employer can't extend my contract anymore so I won't get my new work permit. So, now my common law partner is preparing a family sponsorship application (outland application).
However, I don't understand how can I stay in Canada beyond June 1st (the TRV extension request) if the government does't reply with an approval of my visitor extension (it's taking a really long time for them to process it). I don't want to be separated from my girlfriend.
So I would really appreciate it if someone can advise me on whether I can apply for another visitor extension if I don't get any reply until June 1st, or should I try my luck at the border?
Looking forward to hearing from anyone who can help.
