Who cannot take the oath
Citizenship will not be granted or the oath taken if the person
•is under a probation order;
•is a paroled inmate;
•is confined in a penal institution;
•is charged with or on trial for—or subject to or party to an appeal relating to—an offence under subsection 29(2) or (3) of the Citizenship Act, or an indictable offence under any Act of Parliament, other than an offence that is designated as a contravention under the Contraventions Act;
•is under an investigation by the Minister of Justice, the Royal Canadian Mounted Police or the Canadian Security Intelligence for an offence under any of sections 4 to 7 of the Crimes Against Humanity and War Crimes Act, or is charged with, is on trial for, or has been convicted of—or is subject to or party to an appeal relating to—such an offense;
•has not obtained the authorization to return to Canada as required under subsection 52(1) of the Immigration and Refugee Protection Act; or
•has ceased to be a Canadian citizen under subsection 10(1) of the Citizenship Act during the five (5) years immediately preceding the date of the person’s application.
Subject to the Criminal Records Act, Canadian citizenship shall not be granted or the oath taken if the person has been convicted of an offence under the Citizenship Act or of an indictable offence under any Act of Parliament
•during the three years immediately preceding the date of the person’s application; or
•during the period between the date of the person’s application and the date that the person would otherwise be granted citizenship or take the oath of citizenship.
