No more Concurrent Processing through Vegreville

On July 23, 2010, Operational Bulletin 152 was released and stated concurrent processing was no longer allowed at Overseas Visa offices but was still accepted at CPC Vegreville for applicants in Canada. As of yesterday, September 17th, this Bulletin was updated and concurrent processing is no longer allowed in Canada.

What this means is if you have a work permit that is expiring and you do NOT have a decision on a new LMO application, you cannot apply for an extension and ask CPC Vegreville to wait to make a decision when the LMO is issued. You must STOP working when your work permit expires and if you do receive a positive LMO, apply for Restoration and a new work permit.

This will NOT affect those that applied utilizing concurrent processing before September 17th.

Wow...so this basically ends the 'implied intent' option.

Most people use the extra time implied intent gives someone to carry on working, even if they know the LMO is not coming.

Will this also apply to people on a work visa, who are applying Inland for their PR and have sent an open work permit application??

As of now, those in that situation have been able to keep on working but it sounds like unless you have the LMO when you apply for a work visa there is no way you can work....period.

This will only impact temporary foreign workers requiring an LMO to work in Canada. It won't impact the requirements of other categories as they are not waiting for an LMO to be issued.

You are right. Now you MUST have the LMO to apply for the work permit. If an employer has received a positive LMO before the work permit expires, then the worker applying for the work permit WILL have implied status when applying for a new work permit because they are not asking CPC Vegreville to wait for the decision on the LMO. If no LMO decision has been received when the work permit expires, there is no implied status because you cannot apply for a work permit. If you try this, it will be refused.

Yep....I got ya....I have just read the bulletin you linked too.

This really does alter things, people have been riding on that gray area 'implied intent' for years now.

There is still some gray area that could be played with because of the different timelines involved in getting LMO decisions and WP decisions. I'll let you know if any gray area still exists!
