No LMO, yet!! Can I still send off my papers to extend my WP or what??

Hi All,

Really hope someone can help me with the questions I have. :)

I'm currently on a WP that ends on Dec. 27th. I was let go from my job 2 weeks back due to department cuts and they had promised me back in Feb that they would do my LMO for me.

Anyway, I'm interviewing non-stop and hopefully will get offered a new job in the next 2 weeks. Which will bring me to the end of Nov.

I was first wondering can I send off my application for an extension to my WP without a job offer and have any chance of staying?

Or the more likely option that will happen... If I do get a job offer and get them to start the LMO process ASAP. So say they would be ready Dec. 14th after advertising the role etc. to send off everything (my WP docs with it too). Is that too late? Or can I stay past Dec. 27th and work on my current visa while I'm waiting to hear back?

I'm just worried because it says on the site that you have to apply for an extension to your current WP at least 30 days before.

Would really appreciate anyones help on this. Freaking out and wondering should I just go home! :(

No, you have to have the LMO to apply for the extension, Vegreville no longer accepts concurrent processing. If it is a new job, you can start work until you have a new work permit. As long as the wp application with the LMO is sent before the expiry of your present work permit, you are fine. Vegreville may want 30 days, but the laws says that you only have to apply before the permit expires.

I think there was a typo there, I think PMM meant that you CAN'T start work for a new job until you have a new work permit.

As well, since there is a good chance that you may not receive the LMO before the expiration of your work permit, you should know the following exception to the "no concurrent processing" rule:

"For inland processing, the concurrent processing option will only be allowed for foreign nationals whose work permits will be expiring within two weeks. They must provide proof of a valid job offer, as well as proof that the employer has submitted a request to Service Canada for a new LMO. Applications will be initialized and the processing fee will be processed. Applications will be held for two months (TBC for CAQ) from the date of receipt, after which a determination to either refuse or approve the work permit will be made."

This is a new rule, tho, so I don't think anyone can tell you yet (from their own experience) how this works out...
