Newly PR planning to marry in PH

Hello everyone. I have been reading some of the threads here and I am just hoping if anyone can help me with my concern.

I landed as a PR last November 2011. After a month, I got a job but only as a part-time employee. It pays way higher than the minimum wage here in Ontario. I have a boyfriend who is in the Philippines and to cut the long story short, we were talking and planning of getting married this April-May. Our option is for me to come back in the Philippines and have it done there. Since I am just new in my work, I am planning to stay in the Philippines for about 2-3 weeks only. My concern is that will the Canadian Embassy consider the length of our marriage when we start applying for the sponsorship? Once I come back should I wait for months before applying for his sponsorship or will it not matter since I need to inform them anyways about the change in my marital status. Most of my aunts and uncle did the same thing. After landing shortly in Canada, they came back to the Philippines and married their partners, flew back to Canada and sponsored their spouses and in less than a year, the spouses were here already. However, they did that during the mid 1990s. I am not sure if the same still applies today. Should I also stay there longer after we get married? Lastly, considering that I have been here for less than a year, is it just okay to change my status that soon?

I hope anyone who's experienced the same or are dealing with the same crisis can help me. I will really appreciate any helpful insights right now. Thank you so much in advance. God bless all our wishes and desires.

Hi. When you get married, you can sponsor your spouse right away. No income requirement set by CIC. But you have to send proofs that your relationship is genuine. Old and new pics. Emails. Postcards. Every means of communication you have while apart.

When I got married, I didn't have to change my marital status on my immigration rec. When you file an application to sponsor your spouse, they will automatically update your marital status. What you have to update though is the CRA coz you need to acquire an Option C print out from them needed for your application to sponsor.

It doesn't matter how long or short you've been living here. It's not included on their eligibility conditions. You can sponsor your spouse as soon as you came back provided you have all the necessary docs. :)

One more thing, since you said you came just Nov of last year, you do not have tax record yet. So if you can't provide an Option C, ask for an employment letter from your employer and keep all your paystubs. That's one option if you can provide the Option C printout.

I suggest you check the cic website. Download the guide to sponsorship.

Thanks for the reply CharlieD10.

Hi dadaem. Thank you so much for the information, it was such a relief for me reading what you had to say. I am actually on CIC's website (doing my research about spousal sponsorship) when I accidentally got into this site. I have questions though if you would not mind and I would really appreciate it if you can reply again.

What is CRA and when should I ask for the Option C print out, before going to Philippines or after I come back here? You said you got married and didn't have to inform them of the change in your marital status. Does it mean you also married your partner in the Philippines and came back here in Canada after? Did you send all the documents at Canadian Embassy-Manila? Or were there some documents that you needed to submit from here? I really appreciate your suggestions expecially with the Option C print out. I hope to hear from you again. Thanks! :)

Hi DJCT.

I got married in the Philippines. When I came back, I filed the sponsorship application for my spouse. I sent all the documents to the Case Processing Center in Mississauga. Then when they approved me as a sponsor, they sent the application to the Canadian Embassy in Manila for the second stage.

[ deleted wrong info so as not to mislead you]

I did not update my marital status in CIC. When I filed the application, it was automatically changed from "single" to "married". Because you cannot sponsor a person in the family class unless the person is your spouse, common-law partner, or child. CRA is Canada Revenue Agency. Every year, we file our taxes. They will be the one to issue the Option C printout. But since you just came last November 2011, you don't have any taxation record yet. That was why I suggested you keep all your pay stubs and request an employment letter from you employer.

When you go home and get married, make sure to complete all the necessary supporting documents. Incomplete package can cause delays. There is a document checklist at the CIC website. I used it as my guide, as well as the Guide to Sponsorship (for you) and Guide to Immigrating (for your spouse).

Feel free to ask me if you still have questions or if you need clarification. :)

Have a good one.

Dada

Hi DJCT.

I did an INLAND application. I sent all the documents to the Case Processing Center in Mississauga. Then when they approved me as a sponsor, they sent the application to the Canadian Embassy in Manila for the second stage.

You also have an option to do OUTLAND application. You can file the sponsorship application to the Canadian Embassy in Manila but I don't know how long the process will take because most people do INLAND applications.
This is NOT correct. You filed an OUTLAND application, because the application is being processed at a VISA OFFICE OUTSIDE Canada. An Inland application means that the applicant is in Canada AND the application is processed at Case Processing Centre -Vegreville (Alberta).

All OUTLAND applications are filed at Case Processing Centre-Mississauga and when the sponsor is approved the application is passed to the visa office outside Canada (in your case, Manila) for the applicant to be processed.

You asked "when can you ask for an Option C from the CRA".

You can ask for it once you have filed your income tax return. But you just came last November, so the months you have to file are November and December. Did you get work right away upon landing? Or did you wait for a few weeks to be able to land a job? Say if you came last November and got a job in December, that'll be too short to evaluate for the CRA. Option C is the summary of the income you filed every year. The immigration isn't very strict regarding Option C. When you cannot provide that, they will ask you to provide paystubs and employment letter instead. :)

Sorry to cause confusion. All along I thought INLAND was when you submitted the application here in Canada and OUTLAND to the Canadian Embassy abroad coz that was what my friend told me. But thank you for the clarification CharlieD10. :) Good thing, that wrong info didn't cause my sponsorship anything.
