New born outside Canada to a NON-PR-WIFE and my expiring PR VISA

Hi,

I'm a PR from Edmonton AB which my PR VISA will be expiring in January 2017 (I've been here in Canada for more than 1,400 days). My wife, a NON PR and OUTSIDE CANADA (Philippines) is giving birth end of September this year (09/29/2016 - expected due date). Per Service Canada I can take up to 35 weeks of PARENTAL LEAVE - and I am planning to leave for my vacation in September 09, 2016 going back January 2017 and the plan is to bring them here as soon as I can if CIC permits. I have questions on how I can bring them here and what are the best options for me to take.

1. Should I apply for Citizenship before I fly to Philippines or just renew my PR?

- Should I renew my PR first, then apply for Citizenship when I get back?

- How long it will take for both applications as I need to get results prior my PR expires? Do I need to be in Canada while papers are in process?

2. Given the baby will be born in September, how soon can I file the application for my wife/child? Should I go back earlier to apply as sponsor?

Since you are a PR, you must be physically living in Canada when you apply to sponsor your wife and child and must continue living in Canada while their application is being processed. Short trips outside of Canada (e.g. 3 weeks) are fine. Anything longer and you risk having the application refused.

If you are planning on leaving in September and not returning until January - you will need to wait until you have returned to Canada in January before you can submit the application to sponsor your family.

I am sponsoring my wife. I just had a 1-month trip to my home country from 28th Jan to 28th Feb. Does it affect our application?

1 month should be fine as long as you don't plan on doing this often.

Thank you for you answer. Of course I do not plan doing this often. It costs me lots of money and time to go back to my home country :-[

I forgot to mentioned that my wife and my child to be is in the Philippines. Can I apply the child even if he/she is less than a year old? When I get back here in January, the baby will be 3 months old but I will make sure I'll have the necessary documents needed when I come back. would it be an issue If I am to submit application?

Yes, the baby can be sponsored even though he or she is less than a year old.
