My neighbour family they all applied asylum as whole family one 6 years son and husband wife but 6 months ago neighbour beat his wife she put domestic violence charge on him now by law he not allowed to go close his wife and son but sake of case wife wants to compromise with husband does it impact on husband case ?, I assume wife and kids may get benefit what about husband if they do compromise what do you guys think they still waiting for hearing ?

Domestic violence is a very serious charge. The wife cannot drop the charges against the husband. It is up to the criminal justice system. Many times people are charged and found guilty of domestic violence even if the partner wanted to charges dropped. So the husband may face jail time. Hope the wife and children are in a safe place.

If the husband can’t do the time, then don’t do the crime . It’s pretty cut & dry .
Why should anyone care ? More so in crimes involving domestic violence. Those in my opinion are unforgivable .

In Canada it is often not up to the spouse whether charges go forward for this exact reason. Spouses decide they don’t want to press charges for a variety of reasons including pressure from the extended family, being in a longterm abusive relationship ship where they are no longer strong enough to make the difficult decision to leave, etc.. Your neighbour should be respecting the no contact order and stay away from his spouse and child until he is legally allowed to do so. If you see him you should be calling the police to inform them he is breaking the conditions of his release. If he isn’t respecting the conditions of his release then he will end up with more charges. If he is found guilty it May have an impact on his ability to get protected person status. He needs a criminal lawyer familiar with immigration.
