Needed Emergency Operation in Philippines: Visa Application to go Back Refused

Hi everyone,

I’ve run into a bit of an immigration hurdle and was hoping the good people can help me out.

I was diagnosed with cancer on August 19 and left for my home country, Philippines, by August 21 - (very short notice and very little time to sort things out). I’m fine now as the surgery was able to catch everything.

I had a work permit until June and now I have a visitor permit valid until Dec 11 2016. I applied for a TRV in the Philippines to be able to go back to Canada. I recently got my passport back telling me that my application had been rejected due to not satisfying the immigration agent that I would return once my permit expires.

Factors included:
- Length of proposed stay in Canada (I put 12/11/2016 - which is when my permit expires - as a leave date)
- Purpose of visit (I believe this is may be the culprit…I told them that under the advise of my lawyer, I should stay to work on my PNP/PR applications IN Canada)
- Current employment situation/Financial assets and status (I listed my family’s company in the Philippines and gave our bank certificate to show proof of funds. I also mentioned that they will be supporting my stay in Canada in the meantime).


Changes I’m making to my re-application:

- I do have work while I am in Canada which is from a U.S. employer. I have asked for a Letter of Employment complete with my salary. I work remotely as a film editor for this company. They send HDDs, I edit. None of the content is shown in Canada and my payment is sent back to the Philippines.
- Other than the Letter of Employment, I am hoping that perhaps purchasing a one way ticket back to the Philippines before my visitor permit expires will also help satisfy immigration in seeing that I will return once my permit expires.
- My purpose of visit is to be in Canada while my immigration papers are processing and it is more convenient for my work as well to be nearby, though not necessary. The problem is that I still live in Canada as it really is more convenient for me to not move until I find out what the decision is for my PR. I’ve built a life in Canada having studied and worked there and then being subsequently screwed by Harper’s changes to the immigration laws in 2015. It’s been 8years. If it’s time to go based on the PR decision, it’s time to go. But I didn’t want to pack up and leave until that decision as that is a lot of work.
- I also now have a medical record that states the operation I had done in the Philippines for my cancer. (Perhaps to prove that I left on short notice and that I at least need to come back to tie loose ends).

My backup plan:

My current flight back to Canada is dated for September 24th. I am thinking of re-routing my flight to New York instead where from there I can stay for a week or so. After that I can fly from NYC to YYZ. I have a US visa and I know that I do not require the TRV to enter Canada from the US (the permit itself is enough). Please let me know if you think this is a good backup plan.
