Hi all,

My PR card expires on 24th April. I am currently out of Canada. I have stayed in Canada for 317 days in last 5 years. I had to return to my home country due to health issues of my parents. I wish to extend my PR card validity (renew) on humanitarian and compassionate grounds and I have valid reasons for It.

I wish to move to Canada and meet my residency obligation and eventually get citizenship but I have following queries:

1. Should I apply for PR card renewal (extend) on humanitarian and compassionate grounds from my home country or from Canada?
2. I just got to know from my Canadian landlord that I have to repay CCTB to Canada Revenue Agency. The CRA is asking back the full amount of about 10 months out of which my son was there for 6 months. So am I supposed to return that 6 months money as well?
3. Will I be stopped at Port of entry for the reason that I owe money to Canada revenue Agency?
4. Will all this stop me from getting prevented from getting my PR renewed on humanitarian and compassionate grounds?
5. How long does it take for PR renewal on Humanitarian grounds?

Please suggest and help me find the way out.

Humanitarian grounds is discretionary. There is no guarantee how long it will take or if it will be granted. I would suggest you pay off your dues first before you make a humanitarian claim. Paying off your dues will put you in better standing. You would need to convince CIC that you will continue to stay and fulfill all your obligations.

1. You can't extend your PR card from outside of Canada. You will need to apply for a PR Travel Document under H&C. If the PRTD is approved, you will need to travel to Canada and apply for the PR card from there.
2. No - you won't be stopped at the border because you owe money. Yes - you need to repay the CCTB you were not entitled to receive.
3. The only thing that will prevent you from being approved for a PRTD under H&C is if you aren't able to demonstrate sufficient grounds for H&C.
