Hi all, need one urgent piece of advice. My mother is in Canada on a visitor visa from March 2019. We are extending her stay since then. Her visitor visa expired in 2021. However, we are still getting stay extensions(temporary resident-Permit-VR). We again applied for one as the last stay extension expired on April 2022. That application is in progress.


In the meantime, we applied for her PR 2 times but did not make it in the lottery.


Need guidance on Super Visa Vs temporary resident status extension

1. My mother has a USA visa and she can travel there. Can a super visa be applied from the USA or my mother needs to be in her home country only?

2. Which option should I choose. Take my mother out of Canada and apply for a Super visa or should I keep on renewing my mother's temporary resident status?

3. There is a chance of super visa rejection. There is a chance of rejection of temporary resident status too. Which one has less chance of rejection?

1- There is no such requirement that Applicant must be in Home Country at time of Application
2- This can be your personal Choice
3- In case your 2021 income and Family composition in CA is enough for Qualifying LICO , You can definitely think about Super Visa

Your mother must be out of Canada to apply for a supervisa. Without creating ties to her home country again there are higher risks that her supervisa could be denied so returning to her home country and reestablish ties and then applying for a supervisa is the best idea. She will eventually be refused an extension for her visitor stay. Extensions have been more lenient due to Covid so there is a higher chance that this extension will be denied. Given that she has been out of her home country for so long she should really be spending at least a few months out of Canada before trying to apply to visit again. She remains a visitor so can’t live in Canada and is expected to return to her home country and spend time there as well.

I applied for parent supervisa while my mother was backhome. She still has valid visitor visa so she came to Canada for a few weeks for her birthday and while she was here in Canada she got the biometrics request for super visa. My question is if it will be ok to get the biometrics done in Canada and submit it or will that be an issue? It only states that application should be submitted outside Canada but not sure if biometrics would also have to be done and submitted from outside Canada?
Your help will be greatly appreciated .
