Hi...
I am loosing my job this month...I am on a work permit here under LMO.
So applying for LMO n then work permit will take upto min 4-5 months.....

so my questions are-

1) can i go on EI ?

2)if yes...is it going to effect my PR application in future that i applied for EI ???

please reply.........
 
You can try applying for EI but temporary foreign workers are often refused because unlike a PR or a Canadian that is unemployed, you are not able to take the next job that comes along because you would need a new work permit first. You can still try though.

Could you ask your employer to lay you off temporarily instead of completely? I have known TFW's who got EI based on that they were only laid off temporarily but a temporary lay off automatically turns into a permanent lay off if they don't call you back. It might help you get EI for at least a part of the time you are waiting for your new LMO.

Getting EI will not affect PR applications.

yes you can get EI even though you are on work permit, it has to be valid.
other condition apply regarding why did you loose your job

I don't want to bad news but to my understanding a the WP under LMO if doesn't qualify for EI
the LMO always states that if they have to do layoffs you have to be first and the WP says that you can only work for that employee and have to leave the country once it expires or the contract ends

try it it won't hurt but you will need your REO mailed to you before that
 
not really, i got EI, you can stay in canada until your WP expires

Yes, one can get EI benefits even though you are on Work permit and you are tied to the past employer/location.

You will be paid only till your WP is valid. However, the final decision is based on the officer who analyses your case/reasons of being laid off. But its worth a try. I know a person on WP who has got EI benefits.

I have this urgent issue that I need your help with.

I am on a closed work permit until September 2014, I was laid off from work in March 2013 and I only applied for EI in June 2013, as my employer misinformed me that I can only apply for my EI after I receive my ROE (Record Of Employment) and since my discussions with regards to my lay off lasted a few months I was not given the ROE.

Anyways, I applied for EI in June 2013 and yesterday (July 18,2013), I was sent a letter stating that my EI has been REFUSED and the reason mentioned on this letter was "We are unable to pay you Employment Insurance benefits. Your employment authorization restricts you to working only for "my company's name" while in Canada. Because you are not allowed to work for any other employer, you are not considered available for work."

Now, I am in a severe dilemma as I can't find an employment because of the LMO issue and also, even though I have paid religiously into the EI system and all my hours of work are in perfect order, they have refused me of this benefit, when I desperately need this money.

Now, I have my rent to pay, the car insurance, i am so stressed that I don't know what to do. I was really looking forward to this money.

They have mentioned in the letter that i can appeal this decision within 30 days.

I need your help on what I should do. I am extremely stressed and cannot think right.
I spoke to a few EI agents on the phone, but they were very rude and dismissed me right away, they did not even empathize with me or my situation.

Is there anyone of you who was in my situation and yet got their EI in the last few months?

Please help.
 
You will have to appeal it but being refused because of your work permit is actually very common. I know you paid into EI but as a TFW you still do not have full rights in the system. You would have had the rights to sickness benefits and to parental leave but not to unemployment because like they said, you are not available to take any job that comes along because of your work permit.

I know of TFW's having been granted EI in some provinces but it may depend on the location or even the caseworker.
