Hi All,
I am in tragic situation right now, I have graduated in Canada with 4 years degree last June, 2011. I got a full time job since by 13th, June, 2011 in management field. At that time, I worked under my OCWP, my study permit expired by the end of August 2011 which was correct. However, My OCWP will be expired this year( the end of August 2012). The worst thing is I forgot to apply for PGWP( in 90 days) because of the OCWP expiration date, when I found out about that, I tried to re-obtain my PGWP, the result came out is REFUSED because I missed the deadline already. Recently, I stuck at no where even though I still working full time for over 12 months now. According to the CEC criterias, I am eligible to apply for permanent resident ( full time working after graduated, my IELTS score is 7, my degree).
My question is if I send my application, do they count my fulltime working or they just consider it as my Off campus work?
I am really nervous and worried because I might end up 0 by the end of August 2012.
I also think about do the LMO to extend my work permit, it seems that my current company does not want to because it takes time and money.
Please, if some of you are in my situation or similar, please help me out
I really appreciate any help or advice.

bro...you cannot apply for pr on OCWP.
i mean it looks so funny.

The best thing you can do is Take any 1 year course and get a study permit.
after that get a work permit,
its the best option for u

The work you did under your OCWP after graduation was actually illegal since your OCWP is only valid while you are studying. Once you graduated, it is no longer valid (unless you applied for the PGWP and were waiting for it to come in). It only authorizes you to work while you study or during semester breaks.

I would consult a lawyer to evaluate your options immediately. I would also stop working as any work you do is no longer authorized since your OCWP is no longer valid (regardless of the expiry date).

The work you did under the OCWP was illegal since you were no longer in school full time. You can't use this to apply for CEC.

I agree that speaking with a lawyer would be a very good idea.

Hi All,
I am really thankful for all of your response( even though, It hurts my feeling about illegal work). It seems like my whole 12 months working go to 0. I screwed up and the person who issued my OCWP screwed it up too. Recently, I try to work out my situation with my lawyer, unfortunately he seems lost too. He recommend me to get back to school (postgraduate program), but it's so costly( 21000cads/year).
The only thing that makes me really upset is they screwed up by issueing my OCWP for extra one year( it's supposed to be expired the same day with my study permit),however, I tried to re-obtain my PGWP, they refused it and put all mistakes on me.
I feel like losing my mind, my soul and my faith to this country where I have sacrificed so many things and finally, Im end up with a big freaking 0.
Thanks again guys
I wish whoever sends an application CEC will get a good feedback.
Cheers

So sorry to hear of your problems, it's terrible to trust someone else to keep you informed, only to find out they were wrong but you bear the consequences. It's a harsh lesson to learn that YOU have to be your own expert on your immigration obligations.

Of course I know nothing about your field of interest or academic record, but keep in mind that many (if not most) graduate students are able to obtain funding for their studies, through grants, TA/RA posistions, etc. and don't have to pay out of pocket. It would be worth exploring if the idea of graduate studies is at all interesting to you.
