Is his LOI also expiring on 30 Sep 2021? When was his application approved?
Yes he will get his SP valid till the length of his passport expiry unfortunately. Best bet is for him to renew his passport prior to travelling and take both passports with him. Once he is in Canada, he can then apply for an extension of his SP/TRV on his new passport.
I don't see any issue with study time, validity of TRV and his passport. Border Agent will make decision to admit or not to at POE. Validity of your brother study permit if issued will not exceed expiry date of his passport, and he'll need to renew his passport and apply for an extension. Now given that his SP expires a month before his last day of studies, he need to either renew passport before travel or apply for renewal of passport early and apply for extension. He'll most likely get decision after end of his studies
yes his application got approved and he will soon get enrollment letter that will be valid upto april. He has already completed one semester in canada but the problem is he will be only doing one subject in fall and all others in winter because none are available this fall.
Actually the thing is.. he started his study in fall 2020 online and then after completing 1st semester he got refused. We raised a webform his file reopened and then he recieved visa few days ago. But they issued the visa in back date from july to sep. However the approval was recieved on 16 august. We don’t know what happened. Now he will be travelling to canada and we are confused. Also if he renews his passport now, i think it will be a problem since the visa is tied to the old passport. Also, we have already booked his ticket.
I don't know about India passport regulation, but if he can keep both passport then he can travel with both and Border officer may issue SP depending on validity of new passport in possession.
