Need help with PNP getting stuck and work permit expiry

Hello All,

Here is the whole problem cut short.

Background - I have completed my Masters Degree and graduated out in July 2013. I got my work permit for only 1 year (sadly) valid till May 2014 end. Applied for my PNP Ontario application with all documents and funds on August 2013. Unfortunately due to family issues, had to return back to India and staying here till now.

Got a call from PNP in November that i am short of 2 months of stay for PNP (12 months needed) for which my application can be denied, so if i want that to be successful, i may need to come back and reapply.

Present Situation - PNP decision awaited, may come by Feb end or March. If it is all positive fine, else i have an option to go back stay for 2 more months and reapply, which will go under process only after my work permit is expired and i would have left Canada by that time. Due to this, my application may not be considered again.

Can anyone (expert help) suggest what should i do in this case ? Is there any other way out to extend my work permit or to get PNP application considered again ?

Hope i get some expert opinion in this case.

r u in canada right now ?

if yes, R u working ? if not , then wait for pnp approval and after approval send file to cic and hopefully u will get AOR within 45 days and with that you can renew your work permit ,,

As mentioned in post, i am NOT in Canada, I came back in India for some reasons in August 2013 and i am here since then. And after my conversation in November, they confirmed quota is over so you should come next year to complete these days. I was thinking to go some decision by now and go back in February but now this is a new confusion.

I do not want to spend all the money on the show while the results are clear that the application won't be processed since there is no legal status and i am not in Canada.

The application investigator told me that the application is most likely to be denied since i do not have 12 months needed on file

no option.. in my opinion. if u want PR u have to have experience or PNP approval.

for PNP approval u need 12 month of stay ..


I don't know ur situation but y dont u come back for two months ?

I have 4 years of experience from my jobs in India. I went to Toronto on August 2012 and applied for PNP in August 2013. Between this i had 2 months of vacations which is the main problem right now.

Anyways here are the scenarios -

Scene 1- I come in Feb, my application is denied (hope so not), i stay for 2 months and reapply in May 2014, my permit expires i have no legal status to stay and i have to leave. my application goes under process in August (suppose), they find out i am no more staying in Canada do not have legal status (what's going to happen), i believe that cancels my application, matter over.

Scene 2 - If i know everything is going to happen like this, is there any other way out ?

its doesnt matter if u r in india after completing ur 12 months in canada. there is no such rule that denies ur application on behalf that u r not in canada.

The problem is that in the stay of 12 months I have two months of vacations in which i came back to India.

Now Pnp rules quote for 12 months of physical stay, in that case my application may he denied on this basis stating I have 10 months of stay not 12 as required.

Had I known the vacations will hurt i would have stayed back. Do you know of anyone else facing same thing.
