Need help urgently.

Ok so we are waiting on a lmo it's been 14 weeks so far and then that is going for are pr.
Our visitor visa ran out on the 16th may
We are still in the 90 day period to apply for restoration as we haven't applied yet as we were hoping the lmo would of been here so we have left it to the last minute.
My question is it will cost us 600 $ to get the restoration as we are going to apply the very last minute but I have read that you can get a new visa if you leave at the port of entry and come back in. So can we do that or is it best to stay in Canada and apply for restoration.?We would prefer to go to the border as we havent really got the 600 to spend as my husband's future employer is sponsoring us so far. So would we be able to get a new visa at the port of entry if we prove we are waiting on lmo? Or is restoration are only option as we have been here nearly 6months. We're hoping lmo will be here very soon but not soon enough. Please help

If you leave then when coming back you will be reassessed on the point of entry. There is no guarantee that you can get back in, as the officer can think you are trying to cheat the line… also you have overstayed in Canada and have no proof of a restoration/extension application… and saying you preferred to stay illegally and save money doesn’t help your case.

You can take your chances. I wouldn't recommend it.

Are you classed as illegal though if your still in the 90 day period? We were going to go tomorrow to the border and we still have until Monday to apply for restoration

Yes - you're out of status in Canada.

I am trying to apply online for restoration of status and it's saying my husband and daughter don't need to apply as they don't need a visa ? Is this right or do I need to do single applications?

You can put the three application under the same myCIC profile (the wizard will ask you if you want to add a family member).

Canada gives 90 days to apply for a restoration but this does not imply that you are allowed to stay 90 days without status just because you want to. The 90 days are given for emergencies because Canada thinks something IMPORTANT is stopping you from applying (like maybe you were in an accident).

The more you take to apply for restoration the more chances of rejection (there is no real reason to take more than two weeks from the moment you run out of status).
