Hi,

I am on PR and applying PR for Spouse under Spouse Sponsorship as she is in Canada on Visitors Visa.
(Nationality - India)

My Questions
1. Birth Certificate

- she didn't have a certificate now. She is applying for a Birth certificate. What is baptism certificate? should we submit original Birth Certificate.

India – Instruction(s) for documents
  • Birth certificates issued in this country: If a birth is registered late, include the original baptism certificate and other original documents establishing identity such as:
    • Old school records (Fifth class, Middle standard and Matriculation/secondary school certificate), and
    • Voter's ID card.
2. Visitor
- She landed as visitor in April. This is her first visit to Canada.
- No Stamp is placed on her Passport
- No record is given (landing paper)

What should I submit? Checklist says to give a photocopy of stamp and visa.

3. Police Clearance Certificate
- She got one PCC from India (applied after landing in Canada). Should we submit the original PCC or Photocopy is fine?

Baptismal Certificate is usually issued to people baptized in the Church.......you may not have if you are a Muslim.

CBSA has the record of her entry to Canada which could be shared with IRCC when needed.....so don't worry about the stamp not on her passport..........include a copy of the flight ticket, maybe visa and maybe exit stamp on passport at India airport.

Advice you include the original PCC.......but keep a copy for you personal record.

- explain that you are not a Christian and could not be baptized due to your religion, maybe provide evidence of your religion, provide any reasonable reason why you can't have baptism cert.

- Yes...original copy of Aadhar is okay as it establishing identity

I am not sure what needs to be submitted for below.....

- e.g., any document like joint (husband and wife) account statement, employment benefit plan where the other spouse is indicated like a beneficiary, etc.

2.) Documentary evidence of financial support between you and your sponsor, and/or shared expenses.
- e.g., document like western union transfer to spouse for financial support, document to show money sent or given to spouse, any document for an expense both spouses jointly pay, etc.

3.) Other proof that your relationship is recognized by your friends and/or family (e.g. Letters from friends/family, social media information showing a public relationship, etc.).
- e.g., social media post like Facebook or letters from family and friends recognizing your marriage/relationship.

4.) Proof of past cohabitation, if you are not currently living together but did at one point in the past.
- e.g., proof that you and your spouse lived in the same apartment like rental agreement with both names, mails to show both spouses received mails and lived together, etc.

How can we include original 5th or 10th class certificate.... they might be required in future... and i think IRCC will not return the originals back....

They will return the original...........when you send it to them..........include a letter why they must return your original doccs back to you for future use.

1.) The order of your documents is okay.......keep the spousal sponsorship checklist on top of your application package.......followed by other documents.

Your spouse is currently on a visitor visa.......and i see OWP in your list.....so assume the spousal sponsorship application will be INLAND........note, you are only able to apply for OWP if its Inland Sponsorship........no OWP for Outland sponsorship.

Make sure you pay the correct fees for OWP and Spousal Sponsorship.

if OWP fees in in-complete your OWP may not be approved......which you don't want as it could affect your spouse implied status.

Make sure you have all the required forms and supporting documents as required in the checklist to avoid application return or any delays.......will advice that you ensure you receive AOR1 from IRCC before the visitor visa 6 months expires..........although not mandatory, you may also apply for visitor visa extension, just to maintain visitor status in-case of any unexpected application return.

If sponsorship application is reviewed and complete........IRCC will send AOR1 within 6 to 8 weeks of application receipt.

if she gets AOR before expiration of her visitor visa........then her application package is complete and in-process.........and she will have implied status and expect OWP in 4 months time after AOR1.

For Inland sponsorship......the PA (i.e., person been sponsored) is advised to not travel out of Canada while their PR application is in-process as there is no guarantee of re-entry.........and if travel out and for whatever reason they are denied re-entry.......the Inland sponsorship application may be refused.

Can I leave Canada while IRCC processes my application for permanent residence?

I applied for PCC for my wife from Canada.
She got PCC last week, but there is no stamp on her passport.

i think Indian Embassy will put a stamp in the passport for issuing PCC....

I am confused... is that PCC valid?

if you got the PCC thru the embassy........that's what you have got.....include it.......i think if IRCC needs confirmation....you should be ok.

My wife applied for express entry (she is in pool with 380 points - ofcourse she will never get ITA) ... should the profile be deleted before applying for Sponsorship and OWP.??

Express entry and Sponsorship are 2 different applications for PR..........your wife could apply for Sponsorship and OWP........the sponsorship will be approved based on the proof and genuineness of your marriage/relationship........Express entry profile will have no effect on the sponsorship........so its up to you if you want to delete the Express entry profile.

Although spousal sponsorship does not need a valid temporary status for approval.......your wife will need to have a valid temporary status for the OWP to be approved........it takes 4 months to approve OWP......so will advice you apply for the inland sponsorship while her visitor visa is still valid, and if possible apply for visitor visa extension if required.
