Hi Guys, I am bit confused and it seems have ended up with complete mess.

I have already submitted my profile and my present score is 356 points under Skilled worker category with breakup as under :
Age = 110
Level of education = 120
Official Languages = 88
Second Official Language = 0
Canadian work experience = 0
Foreign work experience = 25 ( My work experience in India )
Skill transferability = 13

My close friend was in Canada with 1.5 years of work experience with 1 year of PG program. He has come back to India. But the thing is there he was being accused with false criminal allegations which was then proved as "False" and he came out from those allegations too.
Now we are planning to get married and put a file from India for Canada PR. So what should we do ? Shall I be the first applicant and he should apply as my dependent or he should be the first applicant??

Our fear is that even if he was being sentenced as innocent in that case but what if he apply's as first applicant and due to criminal record check our file gets rejected??? ::) Who should be the first applicant and who should be the dependent applicant in our case? :-[

What should we do in this case? please help us out in this matter. Awaiting for positive outcome. And thanks in advance for spending your valuable time in reading and replying to my case.

Hi Kay,

First of all, you need to calculate the scores for both scenarios: You as the principal and then he as the principal. You should choose the combination the maximizes your chances of getting an ITA. If you apply as a couple your CRS score will depend on both applicants. And you're probably stronger as a team.

If you're thinking about looking for a way so that you won't have to disclose your situation, I suggest you hire a legal representative, but if they know what they're doing, they will want to disclose everything.

My advice would be to disclose everything by preparing an organized file with the timeline and all the relevant documents. If he was found innocent, there shouldn't be a problem. Depending on the nature of the issue, it could also show up on your police certificate, so you would still have to explain it.

If you were to conceal information and the authorities find out, you would be banned from the process for 5 years. If you disclose everything and get rejected, you could appeal.

Stop worrying and believe in his innocence, put the facts and positive energy in your file and you will succeed.

Best of luck!

Serge
