Need help on status

Hi everyone,
My spouse (common-law partner): Hold PGWP until 2027/01
Me: Hold PGWP until 2025/04

We applied for Spouse open work permit but got rejected few days ago with reason: insufficient to prove we are common-law.
We are preparing more proofs and re-apply again soon

The thing is my PGWP will expire on 2025/04. I have questions related to result of application

- Scene 1: If I got rejected again after 2025/04, what should I do? Can I apply again? (I don’t want to leave Canada)

If I can apply again, after 2025/04 will I be in applied status? Can I work as normal

FYI: Both my spouse and I have TEER1 full-time jobs now

Please advise what should I do in each situation? Thanks

After 2025/04 you will be out of status, so no implied status.

You'd better address the reasons of your refusal. Next refusal maybe more consequential than just a refusal.

Last time, We provided:
- Common law declaration
- Rental Lease together ( > 1 year)
- Driver license same address
- Bank statements same address
- Joint bank account ( > 1 year)

This time, we gonna provide more proofs:
- Insurance with beneficiary
- Our couple photos (with friends and family)
- Tax CRA documents


What else you advise to provide this time to prove our relationship?

The documents are solid, the question is since when they are ?

- Driver license same address
- Bank statements same address
- Tax CRA documents
- Insurance with beneficiary
- Driver license same address ( > 1 year with 2 addresses since we moved)
- Bank statements same address ( > 1 year with 2 addresses since we moved)
- Tax CRA documents (For 2023 Tax)
- Insurance with beneficiary (since 2024/08)

- Bank statements same address is not a joint account.
- Tax CRA documents showing same address is not enough. Did you declare your marital status?
- Insurance with beneficiary is not relevant this case.

So far you show only the same address, not common law relationship.

- Driver license same address (total of 2 driver license is more than 1 year, the current address we just moved from 2024/03)
- Personal Bank statements and joint account has same address
- Tax CRA documents with common law status declaration

You need to be careful with dates. Driver licences were less than 12 months so they were not valid as a proof.

Joint account is really a joint account? Do you have a proof of that? Not only the same addresses on statements.

Do you have a proof from CRA that you declared your marital status?

Also you can include utilities joint accounts, shared expenses, etc.

That should be more than sufficient in theory if all the documents are valid.

An officer should see your common law relationships and shared responsibilities for a period of 12 months, not only that you have the same address.

- Joint bank account: what do you mean with “really joint bank account”, what should we prove in joint bank account (we submitted the bank statements of joint bank account)

- CRA: We have notice of assessment (like OTB, GST…) declares as Marital Status

- Utilities: we don’t pay utilities as Landlord included all in rent

Can you also share example of share expenses?
